What they often lack is the right zoning.
Regional demand for low-latency data access is compounding this. Edge computing architectures require facilities closer to end users, not just in major metros. A facility serving financial transactions or autonomous vehicle data processing can't afford 50-millisecond round trips to a distant hyperscale campus. This creates demand for mid-sized data centers in markets that have never hosted them before — markets where the zoning infrastructure hasn't caught up.
How the Rezoning Process Actually Unfolds
A rezoning application isn't a rubber stamp. For a project of this scale, expect a process measured in months, not weeks, involving multiple layers of government review and genuine community stakeholder engagement.
The typical sequence runs roughly like this: the developer or landowner files a rezoning petition with the local planning department, accompanied by a site plan, environmental assessments, traffic studies, and utility impact analyses. Planning staff review it against the jurisdiction's comprehensive land use plan. Then it goes to the planning commission for a public hearing. Then to the county commissioners or city council for final approval — sometimes with conditions attached.
The conditions matter as much as the approval itself. A municipality might approve a rezoning for data center use while requiring specific screening buffers, noise ordinance compliance for cooling equipment, agreements on utility infrastructure cost-sharing, or community benefit contributions. Developers who've navigated this process in multiple markets know that the negotiation around conditions can be as consequential as the zoning classification itself.
Key stakeholders include more than just the applicant and the government. Neighboring property owners, utility providers, environmental groups, and economic development agencies all have standing to shape the outcome. Utilities, in particular, have become critical voices — a rezoning approval means nothing if the local power provider can't commit to the load interconnection timeline required to make the project financially viable.
What It Means for Landowners and Local Economies
For a landowner sitting on a parcel that gets successfully rezoned for data center use, the financial implications can be dramatic. Agricultural land in many secondary markets trades at $5,000–$15,000 per acre. Land positioned for data center development in a market with active demand can command multiples of that — sometimes $200,000 to $500,000 per acre or more, depending on power availability, fiber access, and proximity to transmission infrastructure.
That's not guaranteed appreciation. Power availability is increasingly the binding constraint. A parcel without a credible path to 50+ MW of utility power within a reasonable interconnection timeline is a parcel that data center developers will pass on regardless of zoning status. The rezoning is a necessary condition, not a sufficient one.
Local economies, though, tend to see real and lasting benefits when these projects land. Data centers are significant property tax generators — a hyperscale campus can produce tens of millions in annual tax revenue for a county. They create construction jobs in the near term and a smaller but well-compensated permanent workforce for operations. They often catalyze utility infrastructure investment that benefits other businesses in the area.
The trade-off communities weigh is real estate. Data centers are land-efficient in terms of economic output, but they don't generate the kind of employment density that a manufacturing facility or logistics hub would on the same footprint. Some municipalities want jobs per square foot, not kilowatts per square foot.
Where Zoning Law Is Heading
Regulatory frameworks are adapting, but not uniformly. Several states have begun developing statewide guidance or model ordinances for data center zoning to give local governments a cleaner framework — rather than forcing each county to reinvent the wheel as requests come in. Virginia, which has a decade of dense experience with large-scale data center permitting, has become an informal reference point for other states working through this.
Tax incentive structures are also in flux. States that have historically offered aggressive sales tax exemptions on data center equipment are facing pressure to revisit those programs as fiscal priorities shift. For developers evaluating sites across multiple states, the tax treatment of capital equipment can swing project economics meaningfully — sometimes more than land cost differentials.
The regulatory environment is no longer uniformly permissive, and developers who treat zoning as a formality rather than a strategic variable are getting surprised. Community opposition has blocked or delayed projects in markets that appeared welcoming on paper. The rezoning process is becoming a genuine test of a developer's ability to build local relationships and make a credible community benefit case.
For infrastructure investors and landowners, the forward-looking position is clear: land with power access, fiber proximity, and a jurisdiction that has either approved data center zoning or demonstrated receptivity to the process is a genuinely scarce asset class. Getting ahead of that curve — understanding local comprehensive plans, engaging with utility interconnection queues, and building relationships with economic development offices before filing — is what separates the deals that close from the ones that stall.
