What You Need to Know About Data Center Zoning Changes

Zoning has never been a glamorous topic, but it’s now one of the most consequential forces shaping where data centers get built, how quickly they can come online, and whether a project pencils out at all.

A new zoning text amendment — ZTA 26-01 — is putting that reality front and center. The amendment signals something broader than a single regulatory update: municipalities are getting serious about establishing permanent rules for data center development, and the industry needs to pay attention.

Understanding Data Center Zoning Regulations

Zoning regulations determine what can be built, where, and under what conditions. For most of the last decade, data centers occupied a gray area in many local codes — large industrial-scale facilities that didn't quite fit the traditional definitions of "industrial," "commercial," or "utility." Local governments largely tolerated them because they generated tax revenue and required relatively few public services compared to, say, a distribution warehouse employing hundreds of workers.

That permissiveness is ending.

As data centers have scaled from modest server rooms to campuses consuming hundreds of megawatts, they've become impossible for zoning boards to ignore. The sheer physical footprint, power demand, water consumption for cooling, and round-the-clock truck traffic have made them visible — and sometimes unwelcome — neighbors.

Zoning regulations for data centers typically address several overlapping concerns: land use compatibility (does this facility belong next to residential or agricultural zones?), utility infrastructure requirements, noise from cooling systems, visual screening, and increasingly, energy sourcing. The rules vary dramatically by jurisdiction, which is exactly why a text amendment like ZTA 26-01 matters — it's an attempt to codify what "responsible development" actually means in practice.

Key Changes in Zoning Laws Affecting Data Centers

ZTA 26-01 represents a deliberate effort to move beyond ad hoc approvals and establish a consistent regulatory framework. The language of the amendment makes clear that the goal isn't to block data center development — it's to channel it responsibly.

That distinction matters. There's a meaningful difference between a jurisdiction that opposes data centers and one that wants defined rules before approving them. ZTA 26-01 appears to fall firmly in the second camp, which is actually better news for developers who operate at scale and can absorb compliance costs that smaller or less-capitalized competitors cannot.

The specific amendments target development standards that have historically been left to case-by-case negotiation — exactly the kind of ambiguity that creates deal risk and slows permitting timelines.

From an infrastructure planning standpoint, the shift toward codified standards is significant. When zoning language is vague, every project becomes a political process. When it's specific, developers know upfront what's required: setbacks, screening requirements, noise thresholds, and power infrastructure contributions. That predictability has real dollar value — it reduces entitlement risk, which directly affects how lenders and equity investors underwrite projects.

Impacts of Zoning Changes on Future Development

The practical effects of data center zoning changes will be unevenly distributed — and that's where the most important business implications live.

Who Benefits

Established developers with existing relationships in jurisdictions adopting ZTA 26-01-style amendments have an early-mover advantage. They can engage in the comment and amendment process, shape language that aligns with their development practices, and build template compliance programs before their competitors. Getting a seat at the table during the amendment process is worth more than any amount of reactive lobbying after the rules are set.

Jurisdictions with clear, coherent zoning frameworks will also attract capital faster. Investors and developers prize regulatory certainty. A county that can say, "here are our data center zoning rules, here's our permitting timeline, here's who you talk to," will outcompete a neighboring jurisdiction still handing out case-by-case approvals — even if the latter is technically more permissive on paper.

Where It Gets Complicated

The challenges cut in multiple directions. For greenfield development on sites that haven't previously been entitled for data center use, new zoning standards mean longer predevelopment timelines and potentially significant infrastructure commitments before a shovel hits the ground. Developers who've been operating in permissive environments may find their pro formas don't survive contact with new requirements around setbacks, screening, or utility contributions.

There's also a real tension between data center development goals and community concerns around power grid strain and visual impact. Amendments like ZTA 26-01 are partly a response to community pushback — which means compliance isn't just about checking boxes; it's about demonstrating that a proposed project genuinely meets the spirit of the rules. Planning commissions in jurisdictions with active community opposition will scrutinize applications closely regardless of technical compliance.

Investment Considerations Amidst Zoning Changes

For investors, data center zoning changes create both a filter and an opportunity.

The filter: assets and development projects in jurisdictions without clear zoning frameworks carry elevated entitlement risk. That risk needs to be priced. A site that looks attractive on a cost-per-acre basis becomes far less attractive if the path to entitlement is uncertain, politically contested, or dependent on a single planning director's goodwill.

The opportunity: jurisdictions that proactively adopt clear data center zoning standards are signaling something important — they want this development and they've done the work to accommodate it. Sites in those jurisdictions, particularly those that already meet the new standards, represent a meaningful de-risking of the entitlement timeline.

From a portfolio perspective, the emergence of formalized zoning regulations also creates differentiation in the infrastructure land market. Entitled land in compliant jurisdictions commands a premium, and that premium is likely to grow as more municipalities adopt restrictive or conditional-use frameworks. Early land positions in permissive-but-serious jurisdictions — those adopting rules rather than bans — are worth examining closely right now.

One observation that often gets missed: zoning amendments don't just affect new development. They can trigger non-conforming use questions for existing facilities that predate the new rules. Operators with older campuses in jurisdictions adopting new standards should audit their compliance posture — particularly on noise, screening, and utility infrastructure — before those questions get raised in a public hearing context.

Best Practices for Navigating Zoning Amendments

Regulatory changes of this type reward preparation and penalize passivity. Here's what the developers and investors who handle this well actually do.

Track amendments before they're finalized. ZTA 26-01 went through a public comment process before adoption. That process is where language gets shaped, carve-outs get negotiated, and relationships with planning staff get established. Developers who show up after a zoning amendment is finalized are playing on someone else's terms.

Engage local planning staff directly and early. Planning departments are often under-resourced and genuinely appreciate applicants who understand the regulatory intent and come prepared with solutions rather than objections. That relationship pays dividends at every stage of the entitlement process — from pre-application meetings through public hearings.

Build a team with genuine local expertise. National land use attorneys and consultants have broad frameworks, but local zoning attorneys who know the specific jurisdiction, the planning commission members, and the community stakeholders are worth their fees many times over on complex projects.

Finally, take the "responsible development" language in amendments like ZTA 26-01 at face value rather than treating it as boilerplate. Jurisdictions that adopt these frameworks are communicating that they want to see good-faith efforts to address community concerns — noise mitigation, visual screening, energy sourcing commitments. Developers who lean into that communication, rather than providing the minimum required, tend to have significantly smoother approval processes.

Zoning is rarely where the exciting conversations about data center development happen. The attention goes to power purchase agreements, fiber routes, cooling technology, and hyperscaler demand forecasts. But right now, data center zoning changes are where the real project risk lives for many developers — and where a well-positioned investor or developer can find genuine advantage.

ZTA 26-01 is a single amendment in a single jurisdiction, but it represents a pattern playing out across dozens of markets simultaneously. The developers and investors who treat that pattern as signal rather than noise will be the ones with entitled, shovel-ready sites when the next wave of demand hits.
