Sixty-nine U.S. jurisdictions have now placed moratoriums on data center construction. Local officials sell these bans as prudent pauses — a chance to catch their breath before the next hyperscale campus breaks ground. The problem is that moratoriums don't stop data centers from being built; they just move them somewhere else, usually somewhere less prepared to handle them.
That distinction matters enormously, both for the communities trying to protect themselves and for the investors and developers trying to plan around an increasingly fragmented regulatory map.
What a Moratorium Actually Does
A data center moratorium is a temporary or indefinite halt on permits, approvals, or construction of new data center facilities within a jurisdiction. In practice, they range from narrow freezes on new applications to sweeping bans that block the expansion of existing campuses. Some are driven by genuine grid capacity concerns, while others are reactive responses to a single large announcement that spooked a city council into action.
The 69 jurisdictions that have enacted these bans represent a meaningful slice of the U.S. development pipeline. Northern Virginia — which handles roughly 70% of the world's internet traffic — has seen intense scrutiny. Markets like Georgia, Texas, and the Pacific Northwest have all had local governments pump the brakes in response to community pressure around power consumption, water use, and traffic.
What these bans have in common is the assumption that saying "not here" is the same as saying "not at all." It isn't.
The Redistribution Problem
When a county in Virginia closes the door on new data center permits, the developer doesn't dissolve the project. They call their site acquisition team and start evaluating the next market on the list. The demand driving data center construction — AI workloads, cloud storage, streaming infrastructure, financial services — doesn't disappear because a zoning board got cold feet.
This redistribution effect is the core reason moratoriums are a flawed policy instrument. A jurisdiction that bans construction exports its tax base, its construction jobs, and its long-term lease revenue to a neighboring county or a different state. Meanwhile, it retains exactly none of the regulatory leverage it would have had if it had engaged with developers at the table rather than locking them out.
The community that says no often ends up with the worst of both outcomes: no economic benefit and infrastructure problems that don't respect county lines anyway.
Consider what happens to grid planning. Power demand from data centers doesn't vanish when a moratorium passes. The load simply materializes in a different substation territory, often one that wasn't part of the regional grid planning conversation. That creates its own set of stresses — on transmission infrastructure, on utility interconnection queues, and on communities that may be even less equipped to manage rapid load growth than the jurisdiction that banned the projects in the first place.
The Long-Term Infrastructure Cost
Moratoriums carry a second-order cost that rarely surfaces in the public debate: they slow down the infrastructure co-investment that data center development typically triggers.
Large-scale data center campuses don't just consume infrastructure; they often help fund it. Hyperscale operators have negotiated agreements to fund substation upgrades, transmission line extensions, and fiber buildouts as part of their development deals. When a moratorium freezes development, those infrastructure investments freeze with it. The utility upgrade that would have served the broader community for decades gets deferred. The fiber corridor that would have unlocked connectivity for surrounding businesses doesn't get built.
There's also a quieter connection to the energy transition that rarely gets discussed. Data centers are among the largest corporate buyers of renewable energy in the country. Microsoft, Google, and Amazon collectively hold gigawatts of power purchase agreements with solar and wind developers. When data center construction stalls in a region, the offtake that was financing those clean energy projects stalls too. Moratoriums sold as environmental protection measures can, paradoxically, slow the renewable energy buildout they're intended to safeguard.
This isn't a hypothetical. Interconnection queues in regions with heavy data center demand are already clogged with renewable projects waiting for the grid capacity that large commercial loads help justify building. Removing that demand signal doesn't make the grid cleaner; it removes one of the key economic levers driving grid modernization.
What Should Replace the Ban?
The alternative to a moratorium isn't unconditional approval; it's structured engagement — and the jurisdictions doing this well are worth studying.
Some localities have moved toward conditional permitting frameworks that tie data center approvals to specific infrastructure commitments: a required percentage of renewable energy procurement, water recycling mandates, and phased construction tied to grid capacity milestones. Others have established community benefit agreements that capture a share of the economic value for local workforce development, school funding, or utility bill relief programs.
The goal should be using leverage, not surrendering it. A jurisdiction with a moratorium has no seat at the table. A jurisdiction with a rigorous conditional approval process can shape a project's design, energy sourcing, water strategy, and community footprint in ways that a ban never could.
Sustainable data center development is achievable. Modern hyperscale facilities are significantly more efficient than the server rooms they replaced — Power Usage Effectiveness (PUE) ratios at leading facilities now approach 1.1, meaning nearly all electricity consumed goes directly to computing work rather than cooling overhead. Liquid cooling, waste heat recovery, and AI-optimized workload scheduling are all compressing the resource intensity of the compute that the global economy increasingly runs on.
Regulators who engage with that technical reality are in a far better position than those who simply say no.
Where This Is Heading
The moratorium wave won't reverse overnight, but the economic pressure against it is real and building. States that have positioned themselves as data center-friendly — through tax incentives, streamlined permitting, and proactive grid investment — are already capturing a disproportionate share of announced projects. Ohio, Indiana, and parts of the Mountain West are seeing project announcements that would have landed in Mid-Atlantic markets five years ago.
For investors and developers, the moratorium map is becoming a core underwriting input. Land in jurisdictions with stable permitting environments commands a premium. Utility interconnection agreements in moratorium-free markets are being treated as strategic assets. The capital that would have gone into constrained markets is being redirected — and unlike the political fights playing out in county commission meetings, that capital reallocation happens quietly and quickly.
The deeper policy question is whether communities can afford to keep exporting that value. Tax revenue from a large data center campus can be transformative for a small county budget. Construction employment during a major build-out is substantial. The long-term property and equipment tax base is the kind of fiscal stability that local governments spend decades trying to attract through industrial recruitment.
Jurisdictions that learn to negotiate from a position of informed strength — understanding what developers actually need, where the project economics are sensitive, and how to structure conditions that protect community interests without killing deal economics — will be the ones that shape how this infrastructure gets built, not just where it doesn't get built.
The 69 moratoriums on the books today are mostly a symptom of a policy conversation that got skipped. Developers moved fast, communities felt blindsided, and bans were the bluntest tool available. That's understandable. But the moratorium phase needs to give way to something more sophisticated because data center construction isn't slowing down — and the communities that figure that out first will be in a position to benefit from one of the most significant infrastructure build-outs of the century.
