A Critical Agreement in DeKalb County Development

Something significant happened in DeKalb County that deserves more attention than it has received. An email exchange between County Commissioner Nicole Massiah and developer Ryan Millsap has surfaced, revealing that a formal agreement was drafted—one that carries real implications for how land development and infrastructure decisions are made in one of Georgia's most consequential counties.

The details are still emerging, but the contours of this situation tell a story about local governance that repeats itself in counties across the country: a developer, a public official, a drafted agreement, and a community that often finds out last.

What the Agreement Reveals

The core of this story is straightforward. Commissioner Massiah and developer Ryan Millsap—a name familiar to those tracking DeKalb's entertainment and real estate sector—were apparently in direct communication about an agreement drafted last year. The specifics of what that agreement promised remain central to why this matters.

When a sitting commissioner exchanges emails with a developer about a drafted agreement, the question isn't just what was agreed to—it's what process was followed to get there.

Developer agreements in counties like DeKalb aren't inherently problematic; they're often necessary tools. Large-scale infrastructure projects—roads, utilities, stormwater systems, broadband conduit—frequently require private developers to coordinate directly with county government on timing, cost-sharing, and permitting. These agreements define who builds what, who pays for it, and what the county gets in return for zoning approvals or entitlements.

What makes this particular agreement worth scrutiny is the channel through which it apparently moved: email, between a commissioner and a developer, with a drafted agreement as the outcome. That's a governance pathway that raises legitimate questions about transparency, public input, and whether the full commission was in the loop.

Infrastructure Is Always in the Subtext

DeKalb County isn't a sleepy exurb; it's a dense, politically complex county bordering Atlanta, with active development pressure across multiple corridors. Any agreement touching land development here has downstream consequences for roads, schools, water systems, and the broader infrastructure load that existing residents already strain.

Millsap's background is in development at scale—he previously led Blackhall Studios, a major film production campus project in DeKalb that became politically charged in its own right. That history matters. Developers with large, complex projects often negotiate terms that bundle infrastructure commitments with entitlement approvals. When those negotiations happen outside public view, the community loses its seat at the table.

Infrastructure commitments made in private agreements often become public obligations—and taxpayers inherit whatever was promised without their knowledge.

The concern here isn't hypothetical. Across Georgia and neighboring states, counties have faced situations where developer agreements quietly shifted the cost burden of road improvements, utility extensions, or drainage infrastructure back onto the public—either because the agreements were poorly structured or because the developer's project evolved in ways that nullified the original commitments. DeKalb has enough infrastructure debt without adding to it through agreements that didn't survive public scrutiny.

The Community Deserves a Clear Answer

Local residents watching this situation unfold are asking reasonable questions: What exactly did the agreement promise? Was it ever formally adopted by the full commission? Did it involve any financial consideration—tax incentives, fee waivers, expedited permitting? And critically, does it still govern anything?

Those aren't gotcha questions; they're the basic due diligence any engaged community should expect to exercise over agreements made in its name.

What's notable is that this story broke through an email—not a formal commission vote, not a public filing, not a press release. That's often how these things surface: a document slips into view, and suddenly stakeholders are playing catch-up on something that was already drafted and apparently agreed upon.

Other developers operating in DeKalb have reason to pay attention too. If agreements can be negotiated informally between individual commissioners and select developers, that creates an uneven playing field—one where access to the right official matters more than the quality of the project. That's corrosive to any market trying to attract serious, long-term infrastructure investment.

How DeKalb Compares to Neighboring Counties

This kind of situation isn't unique to DeKalb, which is both reassuring and troubling. Gwinnett County, to the north, has faced its own controversies around development agreements and the speed at which large projects move through approval channels. Fulton County has struggled with transparency around affordable housing developer agreements. Cherokee and Henry counties—both seeing aggressive residential and industrial growth—have developed more structured frameworks for publicly vetting developer commitments before they're finalized.

The lesson from those cases is consistent: counties that formalize their developer agreement processes—requiring full commission approval, public comment periods, and clear infrastructure obligation matrices—tend to have fewer surprises down the road. The agreements are sometimes slower to execute, but they hold up better legally and politically.

DeKalb has the institutional capacity to do this well. It has county attorneys, planning staff, and a full commission. The question is whether those resources are being deployed to review agreements before they're drafted in email chains or after.

Where Local Governance Goes From Here

Developer agreements are becoming more common, not less. As infrastructure funding grows more complex—blending federal grants, private investment, municipal bonds, and developer contributions—the contractual frameworks governing how those funds flow are getting longer and more consequential. Counties that don't build rigorous processes for managing these agreements will find themselves at a disadvantage: legally exposed, politically vulnerable, and saddled with infrastructure commitments they didn't fully understand when they made them.

For DeKalb specifically, this moment is an opportunity. The Massiah-Millsap email exchange, whatever its full context turns out to be, has put a spotlight on a process question that was probably overdue for examination. The county should use this as a forcing function to codify how developer agreements are initiated, negotiated, and approved—not as a one-time response to political pressure, but as a durable governance reform.

That means clear documentation requirements. It means full commission visibility before agreements are drafted, not after. It means public disclosure timelines that give residents and competing developers a chance to understand what's being committed in their county's name.

DeKalb is a county where the stakes are high and the scrutiny is warranted. Getting developer agreements right isn't just good governance—it's the foundation on which every infrastructure project that follows will either stand or crack.
