Will New Data Center Construction Be Halted?

Bernie Sanders and Alexandria Ocasio-Cortez have introduced companion legislation that could stop new data center construction cold — and the industry is paying close attention.

The bill, introduced in both chambers of Congress, would halt construction on new data centers until Congress takes further action. Details from the legislative text remain sparse in early reporting, but the intent is clear: apply the brakes on one of the fastest-growing segments of infrastructure development in the country. Whether this legislation gains traction or dies in committee, the fact that it exists at all signals a political pressure point that developers, investors, and grid operators cannot afford to ignore.

What the Legislation Actually Proposes

At its core, this is a moratorium bill. Sanders and Ocasio-Cortez are asking Congress to pause new data center development — a sector that has been expanding at a pace that strains power grids, consumes enormous volumes of water for cooling, and increasingly draws scrutiny from communities where these facilities land.

The political logic is straightforward: data centers have become too big, too fast, and too consequential to be treated as ordinary commercial construction.

The timing is not accidental. AI infrastructure has triggered an unprecedented buildout cycle. Hyperscalers — Amazon Web Services, Microsoft Azure, Google Cloud — along with colocation providers and specialized AI compute companies, have collectively committed hundreds of billions of dollars to new capacity. Morgan Stanley estimated in 2024 that AI-driven data center investment could reach $1 trillion by 2027. That scale of development draws political attention, and not always the favorable kind.

Sanders and Ocasio-Cortez have long positioned themselves as skeptics of unchecked corporate infrastructure expansion, particularly when it intersects with energy consumption and environmental justice. Data centers now consume roughly 2-3% of global electricity — a figure that is climbing sharply as AI workloads demand dramatically more compute than traditional cloud applications.

What a Construction Halt Would Actually Mean

A moratorium, even a temporary one, would not simply pause a few projects. It would freeze billions in capital deployment mid-stream.

Data center development operates on long lead times. Sites are acquired, permits pulled, utility interconnection agreements negotiated, and equipment ordered — often 18 to 36 months before a facility goes live. A congressional halt would create immediate uncertainty across every phase of that pipeline. Developers with projects in permitting would face an ambiguous legal environment. Investors already committed to financing rounds would need to reassess risk. Equipment manufacturers — particularly those supplying power infrastructure like transformers and switchgear, which already face multi-year backlogs — would see demand signals scramble.

The secondary effect on grid interconnection queues could be particularly disruptive. Utilities and regional transmission organizations have spent years managing a backlog of data center interconnection requests. A legislative pause would not automatically resolve those queues — it would simply create a new layer of regulatory uncertainty on top of an already stressed system.

For smaller developers and regional colocation providers, the impact would be disproportionate. Hyperscalers have legal teams, regulatory affairs departments, and balance sheets that can absorb delays. Independent developers often do not.

How the Industry Is Responding

Expect the industry response to be fierce, coordinated, and well-funded.

The data center and broader technology sector has significant lobbying infrastructure in Washington. Trade groups like CCIA and individual company government affairs teams will frame this legislation as an attack on American competitiveness — particularly at a moment when the U.S. and China are engaged in a direct competition over AI supremacy. That framing will resonate with a bipartisan bloc of lawmakers who view AI infrastructure as a national security asset.

The economic argument will be equally prominent. Data centers are among the most capital-intensive and job-generating infrastructure projects a community can attract. A single hyperscale campus can represent $1-3 billion in local investment and hundreds of permanent jobs, plus a substantial addition to the local tax base. Governors and mayors — including many Democrats — have aggressively courted these projects. Legislation that halts construction puts those officials in an awkward position relative to their federal colleagues.

There is also a supply chain argument that will be hard to dismiss: pausing construction does not pause the demand for AI compute; it just moves it offshore.

The counterargument from Sanders and Ocasio-Cortez's camp will center on energy equity and grid reliability. Large data centers are already triggering grid capacity concerns in markets like Northern Virginia, Texas, and Georgia. When a single campus can require 100-500 MW of power — enough to supply tens of thousands of homes — the grid implications are real and the concerns are legitimate. The question is whether a blanket moratorium is the right policy instrument.

The Longer-Term Strategic Picture

Even if this specific bill never passes — and the current congressional math makes passage unlikely in the near term — it changes the development environment in ways that matter.

Regulatory scrutiny of data center construction has already been intensifying at the state and local level. Virginia, the world's largest data center market, has seen municipalities push back on density and grid load. Texas has seen debates over water usage. Ireland has implemented restrictions on new data center connections in certain grid zones. This legislation accelerates a trend that was already in motion.

Developers and investors who read this as a one-off political stunt will miss the signal. The smarter read is that data center infrastructure legislation is becoming a permanent feature of the regulatory environment — not a temporary disruption. Projects that fail to account for community impact, grid strain, water consumption, and local opposition will face increasing friction regardless of what happens with this specific bill.

That has direct implications for where capital flows. Sites with clear grid capacity, sustainable water access, community support, and jurisdictions with stable permitting environments become more valuable — not less — when legislative risk enters the picture. The rush to secondary and tertiary markets that's already underway (Ohio, Indiana, Wyoming, the Carolinas) partly reflects developers getting ahead of exactly this kind of regulatory pressure in saturated markets.

For those buying, selling, or financing data center land and infrastructure through platforms like InfraSale, the practical takeaway is this: diligence on regulatory and legislative risk is no longer optional. Sites that look attractive on a pure power and fiber basis need to be evaluated against a political and community context that is shifting faster than many underwriting models assume.

The Sanders-Ocasio-Cortez bill may not become law. But the forces driving it — AI energy demand, grid stress, environmental justice concerns, and community pushback — are not going away. The developers and investors who build that reality into their planning now will be better positioned than those who are still treating this as background noise.
