Brazil added 1.1 GW of solar PV to its grid in the first quarter of 2026 alone. Its monitored power capacity is now 84.81% renewable. Yet, its national energy regulator still hasn't figured out how to legally define the technology that makes all of that generation actually work.
That tension β between a country racing toward renewable dominance and a regulatory framework that can't keep up β is exactly what played out in the first two weeks of April. A historic approval on one hand. A damaging delay on the other. For developers, investors, and storage companies watching Brazil's energy storage regulations inch forward, both moments matter enormously.
Brazil's Renewable Buildout Has Outpaced Its Rulebook
Brazil's grid is one of the cleanest in the world by capacity share, and that's not an accident. Decades of hydroelectric investment created a strong foundation, and a sustained wind and solar boom has compounded it. But variable renewable energy creates a specific operational problem: the sun doesn't always shine when demand peaks, and hydro reservoirs don't respond to every intraday fluctuation.
Battery energy storage systems are the logical answer β and Brazil's regulatory framework has been too slow to recognize them as such. ANEEL began analyzing energy storage as a distinct category back in 2019. By 2022, the agency had published a technical note proposing rules that would formally recognize the technical and economic characteristics of storage within the grid. Public consultations followed. A 30 MW/60 MWh standalone pilot project, inaugurated by transmission system operator ISA CTEEP in late 2022, demonstrated the technology's viability at scale.
And yet, here we are in April 2026 β no final framework.
A Signing Ceremony Worth Paying Attention To
On April 2, ANEEL approved the country's first battery energy storage system co-located with a solar generation facility. The project β a 1 MW/5 MWh BESS paired with Sol de Brotas 7, an existing solar PV plant in Bahia's municipality of Uibai β is modest in size but significant in precedent.
Sol de Brotas 7 appears to be one of seven plants totaling 228 MW in Bahia operated by a subsidiary of Norwegian energy company Statkraft. The battery system will use a 2.3 MW power conversion system with a 0.60 kV inverter output voltage and will share the same grid connection as the existing solar array. Critically, the BESS won't be limited to charging from Sol de Brotas 7 alone β ANEEL confirmed it can also draw from the grid, including nearby wind generation. That flexibility matters operationally.
ANEEL director-general Sandoval Feitosa called it a "moment of great joy," describing batteries as a medium- and short-term solution to the challenge of integrating variable renewables β a challenge that, in his words, "will intensify over time" given Brazil's vigorous growth trajectory.
But here's the insider detail worth flagging: this project was only approvable because it sits alongside an existing generation facility, making it eligible under existing co-location rules. It's essentially a regulatory workaround. The approval didn't happen because Brazil has a coherent battery energy storage system framework β it happened despite the absence of one. That distinction should give developers and investors pause about replicating the model at scale.
Why the Regulatory Delay Is More Damaging Than It Looks
Five days after that signing ceremony, deliberations inside ANEEL told a very different story.
On April 7, board debate on proposed energy storage regulations resumed β but quickly stalled again. A prior request for review from board member Fernando Mosna had reopened proceedings in March. Then director Willamy Frota filed another request for review. Director-general Feitosa then suggested reopening public consultations entirely.
For a process that has been running since 2019, that's a significant setback.
Fabio Lima, director of Brazil's national energy storage trade association ABSAE, was direct: *"There is no technical justification for further delays."* The association acknowledged that board members have the right to request reviews but argued the regulatory process is already mature, has been followed step-by-step by the full board, and that further postponement is difficult to justify on the merits.
When the industry association for a sector says the regulator's own process has run out of legitimate reasons to stall, that's not a complaint β it's a warning signal about investor confidence.
What's actually at stake here? A clear regulatory framework for standalone battery energy storage systems would unlock a category of projects that currently can't be financed. Developers can't underwrite a merchant storage project without knowing how storage capacity will be defined, compensated, and dispatched under Brazilian law. Lenders won't fund what they can't model. Every month of delay compounds that problem β not just for projects in the pipeline, but for the grid reliability challenges that ANEEL's own director acknowledged are intensifying.
What Industry and Regulators Are Actually Saying
ABSAE's position is unambiguous: storage adoption is essential to resolving crises facing Brazil's energy sector, including the inflexibility of electricity supply relative to demand patterns increasingly shaped by variable renewables.
That's not an ideological argument β it's an operational one. A grid that's 84.81% renewable by monitored capacity is impressive. It's also one that needs dispatchable, flexible resources to stay reliable. Hydro reservoirs have historically played that role in Brazil, but they're subject to hydrological risk, environmental constraints, and the reality that reservoir levels can't always be counted on.
The 30 MW/60 MWh ISA CTEEP pilot project that went live in 2022 showed the technology works at grid scale in Brazil. What's missing isn't proof of concept β it's the legal and commercial infrastructure to deploy it broadly.
For regulators, the challenge is that energy storage sits awkwardly across traditional categories: it's not purely generation, not purely transmission, and not purely distribution. Getting the definition right determines how projects are taxed, how they're compensated in wholesale markets, and what obligations they carry. Those aren't trivial questions β but they're also not unanswerable ones. Germany, the UK, Australia, and the United States have all worked through similar definitional challenges and arrived at workable frameworks.
What Comes Next β and Who's Watching
The immediate question is whether ANEEL will reopen public consultations or move toward a final rulemaking decision. Reopening consultations would likely push a final framework well into 2027 β and given that the first consultations already took place years ago, it's hard to see what material new information would emerge.
The more likely pressure point is political. Brazil's energy sector has significant government attention given its role in economic competitiveness and industrial decarbonization. The contradiction between the country's renewable leadership and its storage regulatory vacuum is becoming harder to ignore β particularly as peer markets in Latin America begin to develop clearer storage frameworks.
Developers and investors positioned in Brazil right now should track two things closely: whether ANEEL's board moves to a vote before further procedural delays, and whether the co-located model validated by the Sol de Brotas 7 approval can be replicated meaningfully at larger scale under existing rules. The 1 MW/5 MWh project is a template, not a solution β but for projects that can fit within a solar host's grid connection, it may represent the fastest path to deployment while standalone storage regulations remain unresolved.
Brazil has built a renewable grid that most countries would envy. The regulatory infrastructure to make it fully functional is the next build-out β and it's already overdue.
