Zoning Changes: What They Mean for Data Centers

Data centers don't just need power and fiber; they need permission.

That's the part of infrastructure development that doesn't get enough attention. While developers obsess over megawatts, latency, and land costs, local zoning decisions — made in municipal meeting rooms by city council members — can stop a project cold before a single shovel breaks ground or accelerate it. The gap between those two outcomes often comes down to how well the development community understands and engages with local regulatory processes.

A recent city council session, led by Vice Mayor Chris Haney, put that dynamic on full display. Among the agenda items: zoning for data centers, permit fees, and demolition — the exact cluster of issues that determines whether a data center project gets built on time, over budget, or not at all.

What Zoning Actually Controls (And Why It's Not Trivial)

Zoning laws divide land into categories — residential, commercial, industrial, mixed-use — and dictate what can be built where, how tall, how loud, and how power-intensive. Data centers don't fit neatly into any traditional category.

They look like industrial facilities. They operate like critical infrastructure. They generate significant electrical load, require substantial water for cooling in many configurations, and run 24/7 with the hum of mechanical systems that neighbors notice. A zoning board that hasn't seen a hyperscale facility before may default to its nearest mental model — factory, warehouse, utility plant — none of which capture what a data center actually is or requires.

That categorization problem has real consequences. A facility zoned as general industrial might face restrictions on backup generator fuel storage. One zoned as commercial might hit height or setback limits that conflict with the building's mechanical plant requirements. Getting the zoning classification right from the start isn't administrative housekeeping — it's foundational to whether the project pencils out.

For communities, the stakes run in both directions. Data centers bring significant tax revenue and construction jobs. They also bring massive power demands that can strain local grid infrastructure, and they employ relatively few people per square foot compared to the land and utility resources they consume. Local councils weighing data center zoning aren't just processing a permit — they're making a long-term infrastructure bet.

The Regulatory Moment We're In

The council discussion that included data center zoning isn't an isolated event. Across the country, municipalities are grappling with this question in real time, often without precedent to draw from and without staff expertise in data center operations.

What's driving the urgency? Demand. AI workloads, cloud migration, and the explosion of streaming and connected devices have pushed data center construction to record levels. According to CBRE, U.S. data center capacity under construction hit all-time highs in 2023, with major markets like Northern Virginia, Phoenix, and Dallas absorbing gigawatts of new supply. Secondary and tertiary markets — smaller cities and rural areas with available land and cheaper power — are increasingly in the crosshairs of developers looking to escape the saturation and costs of primary markets.

That means city councils in places that have never hosted a data center are suddenly receiving rezoning applications for facilities that will draw 50, 100, or 200 megawatts of power. For context: 100 MW is roughly the electricity consumption of 80,000 average American homes. The local utility infrastructure conversation alone can take years.

When a council session puts data center zoning on the agenda alongside permit fees and demolition — as the Haney-led meeting did — it signals a community actively working through how to handle this new category of development. The outcome of those conversations shapes the economics of every project in that jurisdiction for the next decade.

The Financial Reality of Zoning and Permit Fees

Permit fees are easy to underestimate. For a data center developer running a $200 million project, a $50,000 permit fee sounds like a rounding error. But fees are only one part of what zoning decisions cost.

Consider what happens when zoning approval requires conditional use permits, environmental impact studies, traffic analyses, public hearings, or phased approvals tied to infrastructure upgrades. Each of those requirements adds months. In data center development, time is not abstract — it's contracted. Hyperscale tenants sign leases with delivery dates. Missing a delivery window can trigger penalties or tenant defection.

The deeper financial variable is what zoning allows in terms of density and expansion. A data center campus model — multiple buildings on a single site, built out over five to ten years as demand grows — requires zoning flexibility that many jurisdictions haven't explicitly built into their codes. Getting approval for Phase 1 only to face a new rezoning battle for Phase 2 is a known hazard in this industry, and it's one that sophisticated developers try to negotiate out of upfront.

The permit fee discussion at a council meeting is often a proxy for a larger question: what's this jurisdiction's real appetite for this kind of development?

How Smart Developers Navigate This

The developers who move fastest through local zoning processes aren't necessarily the ones with the best lawyers. They're the ones who show up before the application.

Pre-application engagement with planning staff is standard practice for experienced infrastructure developers — but it's more than a courtesy call. It's intelligence gathering. Understanding what a planning department's concerns are before you file lets you design around objections rather than respond to them. That's the difference between a six-month approval process and an eighteen-month one.

A few principles that consistently make a difference:

Community education matters more than you'd think. Most planning commissioners and council members have limited exposure to what a data center actually is. Developers who invest in site tours, plain-language explainers, and honest conversations about power usage and noise levels tend to build more durable local support than those who rely on economic impact reports alone. Numbers help; comprehension helps more.

Identify your allies early. Economic development offices, chambers of commerce, and local utilities often have institutional reasons to support data center projects — tax base expansion, infrastructure investment, long-term load commitments that help utilities justify grid upgrades. These stakeholders can carry water in council chambers that a developer cannot.

Don't lowball the infrastructure conversation. If a 100 MW facility is going to require a new substation or transmission line upgrades, get that on the table early with the utility and the municipality. Surprises at the permit stage — "oh, by the way, we need the city to coordinate on a right-of-way" — erode trust fast.

Where Data Center Zoning Goes From Here

The trajectory is toward more structure, not less. Municipalities that have seen data center development — or watched neighboring communities deal with it — are increasingly developing specific data center zoning categories, design standards, and infrastructure contribution requirements rather than forcing every project through a one-off variance process.

That's probably healthy for the industry, even if it creates short-term friction. Predictable regulatory frameworks let developers underwrite projects with more confidence. They also give communities a legitimate mechanism to shape how this development integrates with local infrastructure and planning goals — rather than simply reacting to applications as they arrive.

Technology will keep pressure on zoning frameworks in ways that are hard to predict. Liquid cooling systems are reducing some of the noise and water concerns that complicate approvals. Edge computing is pushing smaller facilities into urban and suburban zones that haven't historically accommodated data infrastructure. And the energy demands of AI training clusters are forcing conversations about co-location with power generation — solar, storage, even small modular nuclear — that will require entirely new regulatory frameworks at the state and local level.

The council meeting where Vice Mayor Haney's group discussed data center zoning, permit fees, and related infrastructure questions is a small data point. But multiply it across hundreds of municipalities navigating the same questions simultaneously, and you get a regulatory environment in rapid formation.

Developers, investors, and infrastructure stakeholders who treat zoning as a late-stage administrative task are going to keep getting surprised. The ones who treat it as a core competency — starting engagement early, building genuine local relationships, and anticipating regulatory evolution — are the ones who will move fastest when sites become available and demand won't wait.
