Cochise County's Bold Data Center Zoning Shift

Cochise County, Arizona, isn't the first place that comes to mind when developers discuss data center markets. That's exactly why what's happening there deserves attention.

While hyperscalers and colocation giants flood into Phoenix's established corridors and compete for the same constrained power allocations, Cochise County is quietly doing something most rural jurisdictions avoid: getting ahead of the infrastructure curve. The county is actively updating its zoning regulations to address data center development before, not after, the industry shows up at the door.

That's a meaningful distinction. Regulatory frameworks that chase development rather than anticipate it create friction, delays, and uncertainty — the three things capital hates most. Cochise County appears to be betting that clarity will be a competitive advantage.

What's Actually Changing in the Zoning Framework

The core of the county's initiative is straightforward: bringing data centers explicitly into the zoning code rather than leaving them to navigate ambiguous classifications designed for industrial or commercial uses that don't quite fit the profile of a modern hyperscale campus.

Zoning regulations written for yesterday's industrial uses were never designed to accommodate facilities that draw 50–100 MW of power, require redundant fiber routes, and generate relatively little truck traffic or employment per acre. The mismatch creates problems for everyone — developers spend months in variance hearings, counties lose tax revenue while bureaucrats argue over classifications, and projects that could have broken ground end up in neighboring jurisdictions with cleaner permitting paths.

Cochise County's updated approach is expected to define data centers as a distinct use category, establish clear criteria around setbacks, utility access, noise mitigation (cooling infrastructure is loud), and potentially create designated zones where the use is permitted by right rather than by exception.

The timeline for full implementation isn't yet locked, but the county is actively moving through its review and public comment process — which means developers who engage now, before the code is finalized, have an opportunity to shape the outcome.

What This Means for Projects in Motion and Projects on the Drawing Board

For any developer or investor currently holding land in Cochise County and evaluating data center uses, the message is simple: pay attention to this process closely. Projects that were previously in a regulatory gray zone — technically permissible under broad industrial classifications but vulnerable to challenge — may soon have a cleaner legal foundation. That reduces entitlement risk, which directly affects land value and project financing.

For new development, the updated code could open doors that weren't practically accessible before. When a use is permitted by right in a designated zone, the path from site control to shovel-ready drops from years to months. That's not a minor operational improvement — it's the difference between winning a tenant relationship and losing it to a market that moved faster.

Cochise County has genuine assets that the data center industry cares about. The region sits at meaningful elevation with cooler average temperatures than the Phoenix basin, which matters enormously for air-side economization — the strategy of using outside air for cooling rather than mechanical refrigeration. Every percentage point reduction in PUE (Power Usage Effectiveness) compounds across a facility's 20-year operating life. Lower ambient temperatures are worth real money.

The county also has relative land abundance and lower land costs compared to the Phoenix metro, where industrial parcels near adequate power infrastructure have become genuinely scarce and expensive. Proximity to Tucson's fiber infrastructure and labor market is close enough to be useful without the cost premium of being inside that market.

Who's Watching — and Who Should Be

The stakeholders most immediately affected break into several groups.

Landowners with large acreage in areas that might be designated for data center use stand to see significant value appreciation if the zoning code creates clear, favorable classifications. Rural Arizona land that's been valued for agriculture or light industrial uses can reprice substantially when data center development becomes a credible exit.

Local developers and commercial real estate professionals who understand entitlement processes will find themselves in demand as outside capital looks for guides through the updated regulatory environment. The developers who understand the new code — who know where the by-right zones are, what the utility interconnection process looks like, and how to move a project through county review — will have a meaningful edge.

For institutional investors and infrastructure funds that have watched the Phoenix and Scottsdale markets compress cap rates and inflate land prices, Cochise County represents a potential early-mover opportunity in a market with legitimate fundamentals rather than hype.

Regional utilities will also be key players. The power infrastructure story is critical — any data center market lives or dies on the ability to access sufficient generation capacity and transmission at reasonable interconnection costs and timelines. How Cochise County's regulatory updates interact with utility planning processes will be one of the most important details to track.

The Longer Arc: Where This Is Heading

The broader context here matters. Data center demand is not slowing down. AI model training, inference workloads, cloud expansion, and enterprise hybrid IT strategies are driving capital expenditure into data center infrastructure at a rate the industry hasn't seen before. The constraint isn't demand — it's the supply of suitable locations with available power, acceptable latency to population centers, and regulatory environments that don't turn a 12-month construction project into a 36-month entitlement odyssey.

Secondary and emerging markets that solve the regulatory piece are actively competing for that capital. Cochise County's zoning initiative puts it in that competition in a way it simply wasn't before.

The long-term investment considerations point toward a window. Early entrants in markets undergoing this kind of regulatory clarification typically capture better land prices, better utility interconnection positions, and stronger relationships with local government than those who arrive after the market is established. The developers who show up to Cochise County's public comment hearings today are doing market research that their competitors aren't.

Whether the county becomes a genuine tier-two data center market or remains a niche opportunity depends heavily on how the power story develops. That's the variable to watch.

Navigating the New Regulations: Where to Start

For developers and investors who want to engage with Cochise County's evolving data center zoning framework, the practical starting points are clear.

Get into the public record now. County zoning amendments go through comment periods where industry participants can provide technical input. Comments from experienced developers carry weight — they help planners write rules that actually work — and they establish your presence in the market before competitors are paying attention.

Retain local land use counsel who knows Cochise County's planning department, not just Arizona zoning law generally. State law provides the framework, but the relationships and local knowledge of how the department actually processes applications determine the timeline in practice.

Commission a power study before you commit capital to a specific parcel. Utility capacity isn't uniform across the county, and the distance and cost to accessible transmission infrastructure varies significantly by location. Sites that look equivalent on a map can have dramatically different interconnection timelines and costs.

Finally, don't wait for the final adopted code to start the conversation with county economic development staff. Jurisdictions that are proactively updating their zoning to attract data centers want to hear from serious developers. That conversation can shape how the code is written — and it tells you more about the county's actual posture toward development than any public document will.

Cochise County is making a deliberate choice to be ready for infrastructure investment rather than reactive to it. For the right projects with the right fundamentals, that's exactly the kind of regulatory environment worth getting in front of early.
