Why the Investment Keeps Coming Anyway
None of this has slowed the build. The economic drivers are simply too strong.
Texas offers a compelling package: no state income tax, relatively low property taxes on commercial development, a massive and growing labor market, and proximity to major fiber routes. The state has historically offered tax abatements on equipment through Chapter 313 agreements (now replaced by Chapter 403 incentives), which significantly reduce the tax burden for qualifying projects during their early years.
More importantly, the AI infrastructure buildout has created demand that is, by any reasonable measure, unprecedented. Training large language models and running inference workloads requires enormous computing clusters, and those clusters need power — lots of it, reliably, with room to grow. Texas, with its deregulated ERCOT grid and significant renewable energy capacity, checks those boxes better than most states.
The result is that developers are in an arms race for sites with adequate power interconnection, and Texas has more qualifying sites than almost anywhere else. That dynamic doesn't reverse on the strength of community complaints alone.
The Legislature Is Starting to Pay Attention
What might actually move the needle is regulatory scrutiny. The Texas Legislature has begun examining the data center boom in response to growing constituent pressure — a notable development given that Texas has generally positioned itself as welcoming to large industrial investment.
The questions legislators are asking are pointed: Are local communities getting adequate notice before projects are approved? Are road-use agreements enforceable and adequately funded? Are water impacts being assessed before permits are granted? Should developments of a certain scale trigger mandatory impact studies?

This matters for developers and investors watching the market. States that get ahead of these issues with sensible, predictable regulation tend to maintain their attractiveness for investment. States that let tension build until a political backlash produces blunt, restrictive legislation end up with an uncertain environment that stalls projects and raises capital costs.
Texas has an opportunity to thread that needle — but it requires developers, communities, and regulators to actually engage rather than talk past each other.
What Responsible Development Actually Looks Like
Some developers are getting this right. The ones with long track records in infrastructure understand that community relations aren't a PR problem — they're a project risk. A data center that faces sustained local opposition can see permitting timelines stretch by years, which destroys returns.
The playbook for better outcomes isn't complicated, even if it's not universally followed. It involves early and genuine community engagement before site plans are finalized, not after. It means road-use agreements with real bonding requirements and third-party inspection. It means acoustic modeling and setback requirements that reflect actual noise impact rather than the minimum required by code. It means water impact assessments that are shared with the public, not buried in a permit application.
None of this is incompatible with the economic case for Texas data center growth. The state will continue to attract this investment — the fundamentals are too strong. The question is whether that growth happens in a way that leaves communities better or worse off.
The answer to that question is mostly a function of choices: choices developers make about how they engage, choices counties make about what they require, and choices the Legislature makes about what baseline protections apply statewide.

The signal worth tracking is which developers and which counties are building the institutional relationships that make long-term development sustainable, versus which ones are treating community concerns as obstacles to be managed rather than problems to be solved.
