The Federal Permitting Maze

Federal review isn't just for projects on public lands. That's the part that catches many people off guard. Under current law, a federal nexus can be triggered by impacts to protected species, disturbance to wetlands, or the use of any federal financing—even if the project sits entirely on private property. The National Environmental Policy Act (NEPA) is the most well-known entry point into this process, but it's far from the only one.

The cost data is equally stark. All developers who submitted projects to federal review reported higher costs. Most saw increases of 6% to 10% on total project expenditures. For a 100 MW solar project—a fairly standard utility-scale installation—that translates to $10 million to $18 million in additional development costs. Those aren't costs that evaporate; they flow downstream to ratepayers as higher energy bills, with Crux estimating up to a 5% increase for customers tied to affected projects.

Delays compound the problem in ways that the headline numbers don't fully capture. In the past year, 94% of respondents reported median project delays of three months or more. The most common delay stretched six months or longer. Eight percent of projects faced setbacks measured in years—an eternity in a capital-intensive industry where financing terms, tax credit windows, and offtake agreements all have clocks running.

Here's the insider reality those numbers represent: a six-month delay doesn't just mean a project comes online six months late. It can mean a developer misses an interconnection queue cycle, loses a tax equity partner who's moved on to other deals, or gets stuck renegotiating a power purchase agreement in a shifted market. The soft costs of uncertainty are often larger than the hard costs of the delay itself.

Developers Are Already Voting With Their Feet

The most telling data point in the Crux report isn't about costs or timelines; it's about behavior.

More than 80% of surveyed developers said they are now deliberately siting projects to avoid triggering a federal nexus. They're making location decisions based not on solar resources or grid proximity, but on regulatory geography. They're asking: where can we build without touching a wetland, a listed species habitat, or a federal dollar?

This is rational. It's also deeply inefficient at a systems level. The best solar resources in the United States—the high-insolation, low-cloud-cover zones across the Southwest—frequently sit on or near federal land. Steering development away from those areas means building on sites with lower capacity factors, which translates to more land, more equipment, and higher levelized costs of energy to generate the same output.

When permitting dysfunction starts reshaping where America builds its energy infrastructure, the effects don't stay on a spreadsheet—they show up in electricity prices and grid reliability for decades.

This kind of regulatory avoidance also adds to the soft costs that already dominate solar project economics. Development expenses, interconnection studies, land control, and legal fees already account for a majority of what makes U.S. solar more expensive than it should be, given where module and inverter prices have landed. Adding geographic constraints on top of that only widens the gap between what's technically possible and what actually gets built.

What Developers Actually Want

The Crux report asked developers to name the single most important change they'd want from federal permitting reform. The answer was revealing: 72% chose more predictable outcomes—not faster timelines, not more agency staff, not simplified processes.

Predictability. That's the ask.

That distinction matters enormously for how policymakers should think about reform. Developers aren't primarily asking for the government to rubber-stamp projects. They're asking for consistent, rule-bound decision-making where they can model a timeline and trust it. A process that takes 18 months but produces reliable outcomes is far more financeable than one that might take 6 months or might take 3 years, with no clear signal about which it will be.

The capital markets piece is critical here. Tax equity investors, project finance lenders, and infrastructure funds all price permitting risk into their deals. Unpredictable federal review doesn't just delay projects—it raises the cost of capital for every project in the pipeline, including ones that haven't encountered a problem yet.

Where This Heads Without Reform

The 11 GW figure from the Crux survey should be understood as a floor, not a ceiling. It represents only the 50 developers who participated, and it only counts the past 12 months. The cumulative drag across the full industry over a multi-year period is substantially larger—and it's landing at the worst possible moment.

U.S. electricity demand growth is no longer a future projection; it's happening now, driven by AI infrastructure buildout, domestic semiconductor fabrication, and accelerating vehicle electrification. Utilities are already revising load forecasts upward at a pace that would have seemed implausible five years ago. The supply pipeline needs to be moving fast and efficiently to keep pace.

Federal permitting clean energy delays represent a self-inflicted wound in that race. The environmental review process exists for legitimate reasons—protecting ecosystems, ensuring public input, managing cumulative impacts on landscapes. None of that is in question. What is in question is whether a system designed for a different era of energy development can be modernized without abandoning its core purposes.

The Crux report concludes that without reform, the process will continue driving up costs for American households. That's probably right. But the deeper risk is structural: if developers continue routing projects around the federal system, the country may end up with an energy infrastructure built for regulatory convenience rather than grid optimization—and that tradeoff has consequences that will last well beyond any individual permitting decision.

The capital is there. The technology is there. The demand is accelerating. What's missing is a federal process that treats clean energy deployment with the urgency the moment actually requires.
