What New Regulations Mean for Pennsylvania Data Centers

Pennsylvania is becoming a flashpoint for one of the most consequential debates in American infrastructure: who controls where data centers get built and under what conditions.

Franklin County — home to Chambersburg — is the latest municipality to take a hard look at data center development within its borders. It won't be the last. As hyperscale facilities proliferate across the Mid-Atlantic, local governments are waking up to the fact that these projects carry real consequences for power grids, water supplies, tax bases, and community character. The regulatory response is only beginning.

What's Actually Happening on the Ground

The specifics of Franklin County's proposed regulations aren't unusual in isolation. What's significant is the pattern they represent. Across Pennsylvania, county and municipal officials are asking questions they weren't asking three years ago: How much power will this facility draw from the local grid? What happens to water resources? Does this create jobs, or just tax revenue and truck traffic?

The shift from passive permitting to active regulation marks a genuine turning point for data center development in Pennsylvania. Developers who built their project pipelines on the assumption of frictionless zoning approvals need to update their models.

Data centers have historically benefited from a regulatory environment that treated them like large warehouses — simple structures requiring minimal special oversight. That era is ending. The sheer scale of modern hyperscale campuses, some consuming 100 MW or more at full build-out, makes that comparison increasingly untenable. A facility drawing that much power isn't a warehouse; it's closer to a small industrial city.

The Operational Reality for Data Center Operators

Regulations targeting data centers typically fall into a few categories: land use and zoning restrictions, energy consumption requirements, water usage limits, noise ordinances (diesel backup generators are louder than most neighbors expect), and — increasingly — requirements around grid interconnection and on-site generation.

For operators, each of these creates a compliance layer that didn't exist before. Some are manageable; others cut to the core of how facilities are designed and sited.

Water is where many operators are most exposed. Cooling is the lifeblood of a data center, and traditional cooling towers consume millions of gallons annually. A facility running air-side economization or liquid cooling can dramatically reduce that footprint — but retrofitting existing designs mid-development is expensive. Regulations that arrive after a project is already entitled but before it breaks ground create exactly this kind of expensive ambiguity.

Energy requirements present a different challenge. If Pennsylvania localities begin mandating renewable energy procurement or on-site generation minimums, developers face both cost increases and timeline risk. Interconnecting a solar array or battery storage system to complement a large data center load isn't a six-month process; it's a multi-year permitting and construction effort in its own right.

The operators best positioned to navigate this environment are those already running sustainability programs — not for regulatory compliance, but because institutional tenants and hyperscale cloud providers have been demanding it for years. For everyone else, compliance isn't just a legal matter; it's a competitive one.

What This Means for Investors and Developers

Here's the non-obvious angle: moderate, well-designed regulation isn't necessarily bad for sophisticated data center investors. It's bad for undercapitalized developers who were counting on speed and low friction to make their projects pencil out.

When permitting becomes more complex, project timelines extend. When timelines extend, carrying costs rise. When carrying costs rise, smaller players struggle to hold entitled land through the approval process. That's a natural consolidation mechanism — and larger, better-capitalized developers often welcome it, even if they complain publicly about regulatory overreach.

Regulation creates barriers to entry, and barriers to entry protect margins for those who clear them.

That said, genuine risks exist. Pennsylvania's regulatory environment is fragmented — what Franklin County proposes, Chester County may not, and Luzerne County may do something else entirely. For developers assembling large portfolios across the state, inconsistent local standards create planning complexity that doesn't exist in states with clearer statewide frameworks. Underwriting a deal in Pennsylvania right now requires assumptions about future regulatory conditions that are genuinely difficult to stress-test.

Investors evaluating Pennsylvania data center assets should be asking hard questions about which counties in a developer's pipeline have active regulatory discussions, what the zoning entitlement status is for each site, and whether water and power capacity commitments are in place before local regulations tighten. These aren't hypothetical concerns; they're live deal risks.

Where Pennsylvania Goes From Here

The demand picture for Pennsylvania data center capacity is strong regardless of regulatory headwinds. The state's geography — positioned between New York and Washington D.C., with access to competitive power markets through PJM — makes it a logical development target. Fiber infrastructure, a relatively stable climate, and existing industrial land make it even more attractive.

But demand doesn't override local politics. Communities that feel excluded from decisions about major infrastructure projects have proven, repeatedly, that they can slow or stop development through the regulatory process. The data center industry has sometimes been tone-deaf on this. Showing up to a county commission meeting with a jobs and tax revenue pitch, while ignoring questions about water drawdown or diesel generator noise, is a losing strategy.

The counties and developers who find productive middle ground will do so by treating regulation as a design constraint rather than an obstacle. Buildings designed with lower water intensity, commitments to grid-scale renewable energy, meaningful local hiring agreements, and genuine community engagement look very different — to regulators and to communities — than projects that treat every requirement as an adversarial burden.

Pennsylvania's data center future will be built by operators who understand that regulatory engagement is now as important as site selection.

There's also a broader policy question worth watching: whether Pennsylvania develops any statewide framework for data center development, similar to what some states have done with renewable energy siting. A coherent statewide approach would reduce the county-by-county fragmentation that currently makes portfolio planning difficult and would give the industry a single set of standards to design toward. That conversation hasn't happened in Harrisburg yet — but given the pace of development activity and the growing list of counties asking the same questions Franklin County is asking, it's probably coming.

Adapting Before You Have To

The developers and investors who will fare best in Pennsylvania aren't waiting for regulations to be finalized before adjusting their approach. They're building projects that could withstand stricter standards — lower water use, renewable energy integration, grid-friendly load profiles — because those standards are coming whether or not any specific county ordinance requires them today.

The regulatory environment for Pennsylvania data center development is tightening. That's not a reason to exit the market; it's a reason to underwrite it more carefully, engage communities earlier, and build projects that are designed for the environment they'll actually operate in — not the one that existed five years ago.
