Georgia is moving to claw back data center tax breaks. Simple version: your NVIDIA GPUs, switchgear, and liquid cooling gear may lose exemptions, and Georgia Power isn’t touching base rates again until 2028 while its data center build gets PSC scrutiny.
Here’s why it matters: on a 20–30MW AI data center, you’re dropping hundreds of millions on gear. A few percent in state and local taxes is eight figures. That dents ROI—but the real constraint is still grid capacity, interconnection timing, and substation delivery.
If I were building today in Georgia: lock a long-term energy rider now and memorialize it in your interconnection and service agreements. Recast your incentive stack with county development authorities—secure bond-for-title/PILOTs to stabilize property taxes. Stage big GPU buys around effective dates and structure procurement cleanly. And keep optionality: parallel a Carolinas or Tennessee site with a live interconnection queue while Georgia policy settles.
Bottom line: incentives move the pro forma, but power-in-hand wins sites.
