Is Your Land Ready for Industrial Zoning?

The data center industry is running out of room — and the race to find it is reshaping land use decisions across the country. When hyperscalers and colocation providers scout new locations, they're not just looking at fiber routes and power availability; they're looking at zoning maps. If your parcel isn't designated industrial, you may already be behind.

Industrial zoning for data centers has quietly become one of the most consequential land use questions in infrastructure development. Owners sitting on commercially or agriculturally zoned land are leaving serious money on the table if they haven't at least explored what a rezoning could unlock.

What Industrial Zoning Actually Means — and Why It Matters

Industrial zoning is a land use classification that permits high-intensity operations: manufacturing, warehousing, utilities, heavy equipment, and increasingly, large-scale data infrastructure. Local governments use it to cluster uses that generate significant noise, traffic, utility loads, or environmental impact away from residential and commercial districts.

For data centers, the fit is intuitive. A hyperscale facility can draw 100 MW or more of power — roughly equivalent to the load of a small city — and requires constant diesel backup generation, cooling towers, and 24/7 truck traffic for hardware logistics. That kind of operational footprint belongs in an industrial zone, and most jurisdictions have figured that out.

The practical distinction matters enormously for developers. Industrial-zoned land typically allows by-right construction of power-intensive uses, meaning you can pull permits without a lengthy discretionary review process. That alone can shave 12 to 24 months off a project timeline — and in a market where power contracts and fiber buildout schedules are moving fast, time is the scarcest resource.

For landowners, the zoning classification directly affects your parcel's market value. Agricultural land in Virginia's Loudoun County — the world's densest data center market — has transacted at $50,000 to $150,000 per acre. Industrial-zoned parcels in the same geography have sold at multiples of that, sometimes exceeding $1 million per acre depending on power proximity and site readiness.

Why Data Centers Want Industrial Land Specifically

It's tempting to assume data centers would favor commercial zones — after all, they're office-adjacent in some ways, with network operations centers, security staff, and occasionally customer-facing spaces. But the operational reality pushes them firmly into industrial territory.

The three variables that drive site selection — power, cooling infrastructure, and setback flexibility — are all better served under industrial zoning frameworks.

Power access is the dominant factor. Industrial zones are typically located near substations and transmission infrastructure, and utilities are generally more willing to extend high-voltage service to industrial districts where the load density justifies the capital expenditure. A 20 MW data center competing for transformer capacity in a mixed-use commercial district faces a very different conversation with the utility than the same facility in an established industrial corridor.

Cooling is the second driver. Large facilities use cooling towers or dry coolers that generate noise and require significant water or refrigerant infrastructure. Industrial zones have more permissive setback and noise ordinances, which reduces design constraints and neighbor complaints.

Then there's the rezoning arbitrage play that sophisticated developers have been running for years: acquire agricultural or commercial land at lower cost, execute a rezoning to industrial, and either develop or flip to a data center operator at a significant markup. It's not effortless — rezoning is a real process with real risk — but the spread can be substantial.

Navigating the Rezoning Process: What You're Actually Getting Into

Rezoning is not a form you fill out and wait. It's a quasi-judicial process that involves local planning staff, public hearings, planning commission review, and ultimately a vote by elected officials. Here's what that actually looks like on the ground.

Know Your Jurisdiction First

Zoning is hyperlocal. The process in Maricopa County, Arizona, looks nothing like the process in Prince William County, Virginia, or Rutherford County, Tennessee — all of which have become significant data center markets in recent years. Before filing anything, you need to understand the local comprehensive plan. If industrial use isn't already contemplated for your area in that document, your rezoning petition is fighting uphill from day one.

The comprehensive plan is the political roadmap — if your proposed use aligns with it, you have a credible case. If it doesn't, you're asking officials to override their own planning framework, which is possible but expensive and slow.

The Application and Review Sequence

Most jurisdictions follow a similar sequence: pre-application meeting with planning staff, formal application submission with site plans and traffic studies, staff review period (typically 30 to 90 days), planning commission hearing, and then city council or county board vote.

The studies required are where costs accumulate. A traffic impact analysis for a large data center can run $30,000 to $75,000. Environmental assessments, stormwater analysis, and utility impact studies add more. Budget $100,000 to $300,000 in pre-entitlement costs before you've turned a shovel — and that's before attorney fees for anyone navigating a contested rezoning.

Where Applications Die

The most common failure point isn't the planning commission. It's community opposition at the public hearing stage. Data centers have a complicated public profile: they create jobs during construction, but only 20 to 50 permanent positions for a facility that might consume 50 MW of power and generate significant traffic during build-out.

Neighbors near proposed sites often mobilize around concerns about noise, water consumption, and the visual impact of large industrial buildings. The developers and landowners who succeed at rezoning come prepared with community benefit agreements, noise mitigation commitments, and sometimes direct engagement with neighboring property owners before the public hearing notice ever goes out.

The Financial Math: What Rezoning Can Actually Return

The cost side of rezoning is real but bounded. The upside, in the right markets, is not.

For a landowner holding 50 acres of commercially zoned land adjacent to an industrial corridor with fiber and power access, a successful rezoning to industrial could increase the parcel's value from $3 million to $15 million or more — depending on market and utility infrastructure proximity. That's not hypothetical; it's the kind of transaction that's been occurring in secondary data center markets like Columbus, Ohio; San Antonio, Texas; and the Carolinas as demand spreads beyond the primary NOVA-Dallas-Phoenix-Chicago corridors.

The ROI calculus changes significantly based on whether you intend to sell the entitled land, ground lease it to a developer, or develop it yourself — and each path has a very different risk and return profile.

Selling entitled land is the lowest-risk exit: you capture the zoning premium without bearing construction risk. Ground leasing to a data center operator provides long-term yield — typically 20- to 30-year terms with creditworthy tenants — but requires patience and carries some execution risk if the developer doesn't close. Developing yourself means the largest potential return but requires access to capital, permitting expertise, and an understanding of a highly technical asset class.

For investors purely playing the rezoning arbitrage, the key underwriting question is: what's the probability of approval, and what's the timeline? In pro-data-center jurisdictions that have already streamlined the process, that math can work in 18 to 24 months. In jurisdictions with active opposition or misaligned comprehensive plans, you could spend three years and $500,000 and still lose the vote.

Where Industrial Zoning for Data Centers Is Heading

Several states have started addressing data center zoning proactively rather than reactively. Virginia — which hosts more than 35% of the world's internet traffic through its data centers — has enacted legislation that provides tax incentives and some streamlined permitting for qualifying facilities. Georgia, Texas, and Arizona have followed with their own incentive structures.

The emerging trend is purpose-built industrial designation specifically for digital infrastructure. Some jurisdictions are creating "technology campus" or "digital infrastructure overlay" zones that explicitly contemplate data centers, hyperscale campuses, and associated power generation — which reduces the ambiguity that has historically created friction in the rezoning process.

The countertrend is also real: as data centers have expanded into communities that didn't anticipate them, local opposition has stiffened. Northern Virginia has seen genuine political backlash against density and power consumption. That tension will intensify as AI-driven demand pushes power requirements from 20 MW per facility to 200 MW or more.

For landowners and investors evaluating parcels today, the window of easy rezoning in top-tier markets may be narrowing. The jurisdictions that welcome data centers are getting more selective. The ones that are ambivalent are getting more organized in their opposition.

If your land has the fundamentals — acreage, power access, fiber proximity, and a path to industrial zoning — the conversation with a developer or broker should be happening now, not after the market moves past you.

The rezoning process is complex, but it's navigable. What's less navigable is waiting until demand consolidates around someone else's entitled land.
