Innovative site selection has quietly become the most important competitive advantage in this market. Developers who can identify markets with genuine grid headroom — rural areas near major transmission infrastructure, regions with surplus hydroelectric or nuclear capacity, sites adjacent to industrial facilities with stranded power — are sidestepping the moratorium risk entirely by operating in jurisdictions that actually want the investment.

The secondary markets emerging as a result of this dynamic include parts of the Midwest, the Pacific Northwest, and the Southeast — areas where power is available, land is cheaper, and local governments are actively competing for large commercial development. For investors watching this space, the site location decision is now a risk factor that deserves as much diligence as the credit quality of the anchor tenant.

Moratoriums, if they come, will be temporary in form but structurally significant in effect. A six-month pause in a hot market can permanently redirect capital — developers don't put projects on hold; they move them. That makes the geographic distribution of data center investment more sensitive to regulatory posture than it's been at any point in the industry's history.

The likely outcome in most jurisdictions isn't a blanket moratorium — it's a de facto one, achieved through interconnection queue backlogs, extended environmental reviews, and increasingly demanding community benefit requirements. Developers who build that timeline into their underwriting and treat regulatory navigation as a core competency will be better positioned than those who expect the process to resemble what it looked like in 2019.

The real opportunity here is for developers who can credibly demonstrate that their projects are part of the infrastructure solution, not the problem. That means co-investing in grid upgrades, partnering with renewable developers to bring new generation online alongside new load, and engaging with utility integrated resource planning processes long before a project is shovel-ready.

Data center development moratoriums are a symptom of a planning system that wasn't designed for the pace and scale of what's being asked of it. The developers who thrive in this environment won't be the ones who lobby hardest against regulation — they'll be the ones who make regulation unnecessary by building the right projects, in the right places, with the right partners.
