What Does Good Faith Look Like in Data Centers?

When a mayor calls a meeting to order and a community member stands up to ask what a company "in good faith" looks like working in their town, that question isn't rhetorical; it's a warning shot. If the developer in the room doesn't have a real answer — not a PR answer, a real one — the project is already in trouble.

Data center development has a community relations problem. Not everywhere, not always, but often enough that the question keeps surfacing at town halls, planning commission meetings, and zoning hearings across the country. The industry is moving fast: hundreds of billions of dollars in capital are chasing sites with power, fiber, and water. What's moving slower is the trust-building that makes those projects stick.

Good faith isn't a legal term here; it's a behavioral standard. And right now, the industry is still figuring out what it actually means in practice.

What Good Faith Actually Means in Infrastructure Development

Strip away the corporate language, and good faith in data center development comes down to one thing: doing what you said you'd do before anyone can force you to.

That sounds simple. It isn't. A developer can show up to every public meeting, submit every required document, and still operate in bad faith — by burying the real impacts in technical appendices, making verbal commitments they have no intention of honoring, or engaging the community only after the major decisions are already locked in.

Good faith isn't about whether you attend the meeting; it's about whether the meeting can actually change anything.

For infrastructure projects specifically, this matters more than in most industries. A data center isn't a retail store that opens and closes without much consequence. It draws significant power — hyperscale facilities routinely exceed 100 MW, with some campus buildouts pushing past 500 MW — it stresses local water systems, transforms the tax base, and changes the character of an area for decades. The community has a legitimate stake. Good faith means acknowledging that stake before breaking ground, not after the lawsuits start.

The Traits That Separate Trustworthy Developers from the Rest

There's a reason experienced local officials can often tell within the first two meetings whether a developer is operating genuinely or running a compliance playbook. A few patterns emerge consistently.

Transparency About Real Impacts

The developers who build lasting community relationships don't just disclose what they're required to disclose. They proactively surface the hard stuff: peak power demand and what it means for the local grid, water consumption figures in a region that might be drought-prone, construction traffic impacts on rural roads, and realistic timelines that account for permitting delays.

When a developer volunteers the uncomfortable information before being asked, it signals they've actually thought through the consequences — and that they're not planning to disappear when problems arise.

Opacity, by contrast, is a red flag that local officials and residents have learned to recognize. If a company can't clearly explain how many megawatts it's pulling, what its water reuse strategy looks like, or what happens to tax revenue commitments if the project gets sold to a different owner, the community is right to be skeptical.

Genuine Community Engagement — Not Theater

There's a difference between a public hearing and a conversation. Too many developers confuse the two. A public hearing where community members can speak for three minutes each, with no mechanism for their input to influence decisions, is not engagement; it's documentation.

Real engagement means meeting with neighbors before designs are finalized. It means sitting down with local business owners, school boards, and emergency services — not just elected officials — to understand what the community needs from a project of this scale. It means being willing to modify a site plan because residents flagged a legitimate concern and then being transparent about that modification.

In practice, this often looks like a developer establishing a community advisory board early in the process, with actual decision-making power over elements like landscaping, lighting, local hiring commitments, and community benefit agreements. Not every developer does this. The ones who do tend to have smoother permitting processes — partly because trust reduces friction, and partly because regulators notice when a project has genuine community support versus manufactured consent.

Commitment to Sustainability That Goes Beyond the Press Release

Sustainability has become table stakes in data center marketing. Nearly every major operator has published net-zero commitments, efficiency targets, or renewable energy procurement announcements. The question communities should be asking isn't whether a developer has a sustainability statement — it's whether those commitments are legally binding, locally verifiable, and tied to consequences if they're not met.

A developer who commits to achieving a Power Usage Effectiveness (PUE) ratio below 1.3 and agrees to report that figure publicly each year is making a real commitment. A developer who promises to "pursue renewable energy options" is not. Communities that have negotiated enforceable sustainability provisions into their development agreements — including clawback provisions on tax incentives if targets are missed — are in a fundamentally different position than those that accepted verbal assurances.

What the Successful Projects Have in Common

The data center projects that have navigated community opposition and come out the other side with genuine local support tend to share a few structural characteristics.

Local hiring provisions with real teeth — not just aspirational language. Some of the most successful agreements include requirements that a defined percentage of construction and operations jobs be offered to local residents first, with workforce development partnerships at community colleges to create a pipeline.

Community benefit funds that are capitalized upfront, not structured as future promises. Several municipalities have negotiated arrangements where the developer contributes to a fund — sometimes in the range of $500,000 to several million dollars — dedicated to local infrastructure, education, or emergency services, with the contribution made before construction begins.

Third-party monitoring of environmental impacts. Rather than asking communities to trust self-reported data, developers who invite independent verification of noise levels, water usage, and energy consumption remove a major source of ongoing tension.

None of this is charity; it's risk management. A project that loses community support mid-construction faces delays that can cost developers tens of millions of dollars. The upfront investment in genuine good faith is almost always cheaper than the alternative.

Building Trust Over Time: The Infrastructure Is Never Just Physical

Here's the non-obvious part that the industry often misses: the relationship doesn't end at ribbon-cutting.

Communities that have hosted data centers for five or ten years have developed institutional knowledge about what these facilities actually deliver versus what was promised. Word travels. A developer with a track record of keeping commitments in one jurisdiction finds doors open faster in the next. A developer who quietly walked back local hiring promises or fought tax assessments in court will find community members in the next town have done their homework.

Infrastructure development trust is a reputational asset — and like most reputational assets, it takes years to build and can be destroyed in a single local news cycle.

Effective developers increasingly treat community relations as an ongoing function, not a permitting phase. That means regular communication with local officials between milestone moments, proactive outreach when something unexpected happens on-site, and consistent presence in the community through local events, charitable involvement, and workforce development partnerships.

The feedback mechanisms matter here too. A community hotline that actually routes concerns to someone with authority to respond — not a general inquiry inbox — signals that the developer takes ongoing accountability seriously. So does an annual community update meeting where residents can ask real questions and get real answers about operations, employment numbers, and what's coming next.

Where the Industry Is Heading

The expectation curve is moving. Communities that welcomed data centers a decade ago with minimal scrutiny are now negotiating more sophisticated agreements. Local officials are consulting with peer municipalities. Some states are beginning to establish standardized community benefit frameworks for large-scale infrastructure projects, which will reduce the information asymmetry that currently allows some developers to offer far less than the market would support.

The developers who have invested in good faith practices aren't just doing the right thing — they're building a competitive advantage. Sites are constrained. Permitting timelines are long. In a market where power availability and community acceptance are both limiting factors, a reputation for trustworthy development is a sourcing asset.

The mayor who called that meeting to order, and the community member who asked what good faith looks like — they were doing exactly what communities should do. The real question is whether the developer in the room had an honest answer.

The ones who do are going to build a lot more data centers.
