Across the country, municipalities are discovering that they have more power over data center siting than developers assumed — and they're starting to use it. For an industry that has spent two decades operating largely under the radar of local politics, that's a significant problem.


Understanding Data Center Moratoriums

A moratorium, in land-use terms, is a temporary halt on permits or approvals for a specific type of development. Towns and counties impose them when they feel regulations haven't caught up with reality — when something is happening faster than local governance can process it.

What Moratoriums Actually Do to Data Center Growth

The direct effect is obvious — delayed projects, deferred revenue, stranded pre-development costs. But the second-order effects matter more.

Hyperscalers and large colocation operators have the resources to absorb delays and fight regulatory battles simultaneously. Mid-tier developers and smaller operators don't. That math filters down to how much developers can offer for land, which affects landowners, which affects local tax bases — the ripple effects are wider than they appear.


Navigating Local Regulations Without Losing the Deal

The developers who are moving projects forward in constrained regulatory environments are doing something their peers aren't: they're showing up before the moratorium gets written.

By the time a town votes to pause permitting, the political dynamic is already set. Opposition has organized. The commission or council has heard mostly from concerned residents and almost nothing from the industry. Developers who engage early — presenting to planning boards, hosting community information sessions, proactively addressing water and power concerns with data rather than talking points — routinely outperform those who treat local government as a permitting obstacle to be managed after the fact.

The developers winning approvals right now are the ones who figured out that a town council member who understands what a data center actually does is far less likely to support a moratorium than one who's only heard about them from environmental groups.

Practically, this means a few things. Engage local economic development offices early — they're often allies who can help frame the project positively internally. Commission independent studies on water use, traffic, and grid impact before anyone asks for them. Structure community benefit agreements that are specific and meaningful, not vague promises of "local hiring." And if a project is near sensitive environmental areas like watersheds, get ahead of it with a credible mitigation plan before the Inland Wetlands Commission has to ask.

The legal route — as Alimi's case illustrates — is sometimes necessary. But litigation is expensive, slow, and permanently damages the relationship with the community in which you're trying to build. It's a last resort, not a strategy.


Where This Is Headed

The moratorium trend is not going to reverse. If anything, it will intensify as AI-driven compute demand pushes data centers toward larger footprints, higher power draws, and more aggressive siting timelines. Communities that feel bypassed by the process will continue reaching for the regulatory tools available to them.

What will change is the legal and legislative framework around those tools. Several states are already considering pre-emption legislation that would limit municipalities' ability to impose categorical bans on data center development — similar to laws that now exist in many states around housing. That's a live political fight, and its outcome will determine whether the Morris case is a curiosity or a harbinger.

For developers and infrastructure investors, the smart positioning is to treat community engagement as infrastructure — not a soft cost to be minimized, but a core competency that determines whether projects get built. The sites that will move forward fastest in the next decade aren't necessarily the ones with the best power costs or fiber access. They're the ones where the developer did the work to make the community a partner rather than an obstacle.

Bantam Lake is a small body of water. The questions it's raising aren't small at all.
