90-Day Data Center Moratorium: What You Need to Know

When a rural county zoning committee votes to pause data center development, it rarely makes national headlines. However, the Logan County Zoning Committee's decision to implement a 90-day data center moratorium is precisely the kind of local decision that quietly reshapes how and where critical infrastructure gets built — and who controls that conversation.

This isn't just a story about one county hitting the brakes. It's a signal about the growing tension between the relentless demand for data infrastructure and the communities being asked to host it.

What a Data Center Moratorium Actually Means

A moratorium isn't a ban. That distinction matters enormously for developers, landowners, and investors watching this situation unfold.

What the Logan County Zoning Committee approved is a temporary freeze — 90 days — during which no new data center projects can receive zoning approval or advance through the permitting process. The intent is to create a window for local officials to assess existing zoning laws, evaluate community impact, and potentially rewrite the rules before the next wave of development applications hits their desks.

Ninety days sounds short, but in the infrastructure development calendar, it's enough time to kill deal momentum, expire option agreements, and send developers scouting alternative sites.

For projects already in early-stage negotiations — where land control is everything and timing is fragile — a moratorium creates real financial exposure. Developers holding site control through options or letters of intent now face a hard calculation: wait it out, renegotiate terms, or walk.

The reasons behind Logan County's decision aren't fully detailed in public reporting, but the pattern is familiar. Counties across the Midwest and Southeast have been grappling with a surge in data center interest driven by AI infrastructure buildout, hyperscaler expansion, and the search for affordable land with available power. Local governments, often caught flat-footed by the speed of this activity, are reaching for the one tool they have to slow things down: the temporary moratorium.

What This Means for Infrastructure Development

The practical impact extends beyond Logan County's borders. When a jurisdiction imposes a moratorium, it doesn't just freeze local projects — it signals to the broader development community that the regulatory environment is uncertain, and uncertainty is expensive.

Data center site selection is a multi-variable optimization problem. Developers weigh power availability, fiber connectivity, tax incentives, land cost, climate risk, and — critically — regulatory predictability. A county that has already demonstrated a willingness to pump the brakes becomes a higher-risk target on the site selection matrix.

That said, experienced developers know that moratoriums can cut both ways. If Logan County emerges from its 90-day review with cleaner zoning language, designated data center overlay districts, and clearer permitting timelines, it could actually become a more attractive destination post-moratorium. Ambiguity is the real enemy of development, not regulation.

Stakeholder reactions will depend heavily on where each party sits in the deal stack. Landowners who have been approached by developers are watching closely — their leverage shifts depending on whether the moratorium narrows the field of interested buyers. Local utilities and economic development offices, which have often been enthusiastic about data center projects for their tax base contributions and construction employment, will be monitoring whether the county's review process threatens to price them out of a competitive market.

Zoning Laws and Why They're Struggling to Keep Up

Zoning codes were not built for the data center era. Most municipal and county zoning ordinances classify land uses in categories that made sense for the industrial economy: residential, commercial, light industrial, heavy industrial. Data centers don't fit cleanly into any of these buckets.

A hyperscale data center draws as much power as a small city, generates significant truck traffic during construction, then becomes nearly invisible in daily operations — no employees commuting in, no retail customers, minimal noise. That profile breaks every traditional impact assessment model that zoning boards rely on.

Logan County's situation reflects a broader pattern. Jurisdictions that never anticipated becoming data center targets are suddenly fielding applications from developers representing Google, Microsoft, Meta, and their supply chain partners. The zoning language that governs these decisions was often written decades ago, and it shows.

Historically, zoning changes in rural counties have moved slowly — measured in years, not months. A 90-day review period is an attempt to compress that timeline without skipping the stakeholder engagement and legal review that legitimate zoning reform requires. Whether 90 days is actually sufficient is a real question.

What Industry Experts Are Watching

Professionals who track data center site selection for a living will tell you that Logan County is not an isolated case. Jurisdictions in Virginia's data center corridor, Central Texas, the Phoenix metro, and rural Indiana have all wrestled with some version of this tension.

The most sophisticated local governments have responded by getting ahead of demand — proactively creating data center-specific zoning overlays, establishing clear infrastructure requirements, and engaging utilities early to understand capacity constraints. Those that haven't done that work often react the way Logan County has: with a pause that buys time but also introduces risk.

From a long-term perspective, the moratorium could have one of three outcomes. First, the county conducts a thorough review, updates its zoning framework, and resumes development activity with clearer rules — the best-case scenario for everyone. Second, the review drags past 90 days, the moratorium gets extended, and developers redirect capital elsewhere, leaving the county on the sideline during a critical infrastructure buildout cycle. Third, community opposition intensifies during the review period, and the county adopts restrictive zoning that effectively excludes large-scale data centers — a decision that has long-term economic consequences the community may not fully appreciate until the tax revenue comparison becomes visible.

The counties that handle this well will have a seat at the table as AI infrastructure spending accelerates. Those that mishandle it will spend the next decade watching that investment flow to their neighbors.

What Comes Next — and What Stakeholders Should Do

The 90-day clock creates urgency, but it also creates opportunity if the right parties engage constructively.

For developers and investors with active interest in Logan County, the playbook is straightforward: don't go dark, don't go adversarial. Engage with the zoning committee's review process directly. Provide data on comparable projects — tax revenue generated, construction jobs created, utility investment triggered. Help local officials understand what modern data center zoning frameworks look like in jurisdictions that have gotten this right. For landowners, this is a moment to understand your options agreement terms and where you sit if a developer decides to walk rather than wait. Get clarity on your position before the 90 days expire.

For economic development professionals in Logan County, the review period is a chance to shape the outcome rather than just react to it. The counties that have attracted the most data center investment aren't the ones with the cheapest land — they're the ones that built a reputation for knowing how to execute a project efficiently. That reputation starts with how a zoning review is handled.

The Logan County data center moratorium is a local decision with implications that scale. As AI-driven infrastructure demand continues to outpace local planning capacity across the country, expect to see more of these pauses. The question isn't whether communities will push back — they will. The question is whether local governments and the development industry can build the frameworks to turn that friction into workable policy before the capital moves on.

Ninety days. Use them well.
