Can Townships Control Data Center Zoning?

When a township trustee stands up and states that his government doesn't have the authority to freeze a data center project or rezone land to block it, that's not an admission of defeat — it's a statement of law. For developers, landowners, and investors watching data center development spread into suburban and rural jurisdictions, that statement matters enormously.

The collision between local political will and actual legal authority is one of the most consequential fault lines in infrastructure development right now. Communities want control. Trustees, planners, and courts are drawing the lines on how much control they actually have.

Zoning Laws and Why Data Centers Test Their Limits

Zoning is, at its core, a municipality's tool for sorting land use — separating industrial facilities from residential neighborhoods, retail corridors from agricultural land. But the modern data center doesn't fit neatly into those legacy categories. It's not a factory. It's not an office building. It's a power-hungry, water-intensive, 24/7 critical infrastructure facility that can consume 20 to 100+ megawatts of electricity while employing fewer than 50 people on-site.

That mismatch between physical footprint and functional category creates genuine ambiguity. Many zoning codes were written before hyperscale computing existed. When a 500,000-square-foot data center arrives in a township that only has categories like "light industrial," "heavy industrial," and "commercial," local officials are forced to interpret their own codes — and interpretation creates legal exposure on both sides.

Data center zoning disputes often aren't about zoning at all — they're about who gets to decide what a data center is.

For developers, this ambiguity can be an opportunity. A well-placed land parcel that qualifies under existing industrial zoning may not require any variance or special-use permit. For communities that feel blindsided by a facility they didn't anticipate, that same ambiguity becomes the source of every grievance.

Township Authority: Where the Legal Boundaries Actually Sit

Here's the core issue that the DeChiara statement cuts to: townships operate within a framework of delegated authority. They can regulate land use — but only within the powers granted to them by state law. They cannot arbitrarily halt a project that is legally compliant with existing zoning. They cannot simply redraw zoning maps as a tactical move to block a specific development that's already in process.

That's not a technicality. It's a constitutional boundary rooted in due process and equal protection. Courts have repeatedly struck down zoning changes that were transparently targeted at a single applicant rather than reflecting genuine planning policy. The legal term is "spot zoning," and it cuts both ways — a change that arbitrarily singles out one parcel for less favorable treatment is just as vulnerable as one that grants unreasonable advantages.

Moratoriums are a separate tool, and townships do sometimes have legitimate authority to impose temporary development freezes while they update their codes. But those moratoriums must be enacted through proper procedure, applied broadly, and tied to a genuine planning process — not triggered by one project generating community opposition.

A township that tries to use a moratorium as a targeted roadblock, rather than a genuine planning pause, is handing the developer a viable lawsuit.

What townships *can* do is significant, though. They can enforce legitimately adopted zoning requirements around setbacks, noise limits, lighting ordinances, stormwater management, and traffic impact. They can require environmental impact assessments. They can mandate public hearings. They can negotiate development agreements that extract community benefits as a condition of approval. These are real levers — and sophisticated developers expect to engage with them.

The Factors That Actually Shape Outcomes

When a data center project lands in a township, the decision process rarely comes down to pure legal analysis. Several overlapping factors determine whether it gets built, gets modified, or gets tied up in litigation for years.

Environmental and Infrastructure Realities

Data centers require serious power infrastructure — often needing substation upgrades or new transmission line interconnections that affect surrounding properties. Water consumption for cooling can run into millions of gallons annually at large facilities. These aren't hypothetical concerns that NIMBYs invent; they're engineering realities that legitimate environmental review should address.

Townships that engage seriously with these questions — commissioning independent assessments, requiring developers to model grid impact, establishing stormwater runoff requirements — build a defensible record. That record protects them legally if a project proceeds and also if they deny it.

Jurisdictions that skip that process and rely on political opposition alone end up exposed. When the developer's lawyers show up with a traffic study, a grid interconnection analysis, and a noise compliance report — and the township has nothing — the legal outcome is predictable.

Community Feedback: Real Input vs. Political Theater

Public comment matters, but it matters in specific ways. Courts don't weigh the volume of opposition; they evaluate whether the zoning decision was made through a legitimate process that considered relevant factors. A township board that votes no because 200 residents showed up angry, without any findings tied to zoning criteria, has essentially built the developer's appellate case for them.

The communities that successfully shape data center outcomes are the ones that translate public concern into specific, code-grounded conditions. Noise ordinance enforcement. Landscaping buffer requirements. Diesel generator testing restrictions. Lighting standards. These are the mechanisms that actually stick.

Economic Reality That Townships Can't Ignore

Opposition to data centers often underestimates the economic weight on the other side of the scale. A mid-sized data center — say, 100 MW of capacity — can represent $800 million to $1.5 billion in capital investment. Property tax revenue from that facility can dwarf anything else on the township's tax rolls.

The job creation argument is more complicated. Data centers don't generate large permanent workforces — 30 to 50 technical staff is typical for a facility worth over a billion dollars. But construction employment during a 2-3 year build-out can be substantial, and the supply chain effects (electrical contractors, HVAC, security, maintenance) extend into the local economy in ways that don't show up in the headline employment number.

The township that blocks a data center on procedurally shaky grounds may win the political moment and lose a decade of tax revenue.

For elected officials, this is genuinely difficult math. The residents who oppose the project vote in every election. The tax benefit accrues to the general fund over 20 years. The incentive structure doesn't naturally favor long-term economic thinking — which is why so many of these disputes end up in court instead of in planning negotiations where they'd be better resolved.

Where Regulation Is Heading

Several states have moved to clarify — and in some cases preempt — local data center zoning authority precisely because the current patchwork is creating investment uncertainty. Virginia, which hosts the largest concentration of data center capacity in the world in Northern Virginia's Loudoun County corridor, has grappled repeatedly with the tension between local planning control and regional infrastructure needs.

The emerging regulatory pattern points toward a few directions. First, more states are likely to establish baseline standards for how data centers can be classified and regulated, reducing the jurisdictional lottery that developers currently navigate. Second, data centers are increasingly being woven into state energy planning conversations — because a 100 MW facility affects grid management in ways that cross county lines.

Third, and perhaps most consequentially, the explosive growth of AI infrastructure is accelerating the timeline. Training clusters for frontier AI models require 500 MW to 1+ GW of power capacity. Those facilities aren't going into small townships — but the secondary wave of inference infrastructure, edge computing nodes, and colocation capacity absolutely is. Townships that don't have clear, updated data center zoning frameworks in place will face these decisions without a map.

The DeChiara situation — a trustee acknowledging the limits of his own authority — reflects a broader reckoning happening in local governments across the country. Legal authority and political desire aren't the same thing. The townships that understand that distinction early and build legitimate regulatory frameworks rather than improvised opposition are the ones that will actually shape how this infrastructure gets built in their communities.

Those that don't will mostly just generate legal fees.
