Massillon's Bold Move: Legal Help for Data Center Zoning

When a mid-sized Ohio city starts lawyering up over data center zoning, something bigger is happening than a local planning dispute. Massillon's decision to seek legal counsel to navigate data center zoning regulations — centered on the historic Republic Steel site — signals a tension playing out in municipalities across the country: the infrastructure boom is moving faster than the rulebooks governing it.

This isn't just a niche story about one city's bureaucratic growing pains. It's a preview of how American communities will wrestle with the collision between legacy industrial land, modern digital infrastructure, and the clean energy systems that power both.

The Zoning Problem Nobody Planned For

Massillon, like dozens of Rust Belt cities, has spent decades trying to figure out what to do with the bones of its industrial past. The Republic Steel site represents exactly the kind of large, brownfield parcel that developers now covet for data center development — plenty of acreage, existing heavy electrical infrastructure, and proximity to fiber corridors.

But zoning codes written for steel mills don't automatically accommodate server farms. The use cases are superficially similar — both are industrial, both consume enormous amounts of power — yet the regulatory differences matter enormously. Data centers generate almost no truck traffic, no emissions, minimal employment relative to their footprint, and completely different stormwater profiles than heavy manufacturing. Most municipal codes simply weren't written with that profile in mind.

When your zoning ordinance was drafted before cloud computing existed, you don't just have a paperwork problem — you have a fundamental mismatch between law and economic reality.

Seeking legal help isn't an admission that something went wrong. It's an acknowledgment that the regulatory framework needs expert interpretation, and possibly rewriting, before a project of this scale can move forward cleanly. The smart play for Massillon is to get ahead of potential litigation rather than react to it after permits are issued.

What the Legal Dimension Actually Means

Zoning disputes involving large infrastructure projects have a way of dragging on. Neighbors challenge conditional use permits. Environmental reviews get contested. Adjacent property owners claim diminished value. Any one of these vectors can stall a project for 18 to 36 months — long enough for a developer to walk away.

Data center developers are particularly sensitive to timeline risk. Unlike a retail center or apartment complex, a hyperscale data center often has contractual commitments to customers that depend on specific go-live dates. A zoning fight that stretches past 24 months doesn't just delay a project; it can kill it entirely.

Massillon bringing in legal expertise early suggests city leadership understands something that many municipalities learn the hard way: proactive legal structuring is cheaper than reactive litigation.

The specific legal questions likely involve how to classify data center use within existing industrial or commercial zoning categories, what variance processes apply, whether the Republic Steel site's brownfield designations create specific remediation obligations, and how to structure public notices to minimize grounds for third-party legal challenges. None of this is insurmountable. All of it requires someone who has done it before.

Getting clean energy regulations right from the start is equally important — because most large-scale data centers now come bundled with renewable energy commitments, either through direct ownership of solar and storage assets or through power purchase agreements. Those energy structures carry their own permitting and interconnection requirements that interact with local zoning in ways that can surprise everyone involved.

The 50% Tax Break: Who's Really Winning Here?

The reported 50% tax abatement tied to this project is where the community conversation gets genuinely complicated.

Tax incentives for data centers have become nearly universal. States and cities compete aggressively for this infrastructure because the headline numbers are impressive: data centers represent billions in capital investment, generate substantial construction employment, and create lasting property tax and utility revenue. The pitch is easy to make at a city council meeting.

The counter-argument deserves equal airtime. A 50% tax abatement on a facility that might employ 30 to 50 permanent workers — typical for a modern, highly automated data center — means the community is forgoing significant revenue per direct job created. Schools, fire departments, and road maintenance all take a back seat to a deal that primarily benefits a developer and, eventually, a tech company paying to colocate or lease capacity.

That doesn't make the deal bad. It makes it complicated. The net present value calculation for Massillon depends heavily on factors that rarely make it into the press release: How long is the abatement period? Does it phase out or cliff-end? What utility revenue will the city capture given the data center's power consumption, which can easily run 20 to 100 megawatts for a meaningful facility? What are the remediation cost offsets for activating a brownfield that would otherwise sit idle and potentially become a liability?

A 50% tax break on a site generating $0 in taxable revenue is still better than 100% of nothing — but the terms of how and when Massillon transitions to full taxation matter more than the headline percentage.

Communities that negotiate well on phase-in timelines, clawback provisions tied to employment minimums, and utility revenue sharing tend to come out ahead. Those that hand over incentives without those guardrails often find themselves in a different conversation five years later.

Clean Energy Infrastructure and the Long View

There's a dimension to the Massillon situation that extends well beyond city limits. Data centers are now among the largest individual loads on the electrical grid, and the push to power them with clean energy is intensifying — driven by corporate sustainability commitments, state renewable portfolio standards, and increasingly, federal incentives tied to the Inflation Reduction Act.

A data center sited on the Republic Steel property will need serious power. Depending on scale, that could mean a new substation, transmission upgrades, and potentially co-located solar or battery storage assets. All of those require their own permitting pathways, and in Ohio, they interact with both local zoning and PUCO (Public Utilities Commission of Ohio) jurisdiction.

This is where the legal complexity compounds. A project that looks like a data center to the city planning board also looks like a utility-scale energy consumer to the grid operator, and potentially like an energy generator if it includes on-site renewables. Those aren't the same regulatory conversation, and they don't always happen in the same room.

The municipalities that get this right will become magnets for the next wave of clean energy-adjacent infrastructure investment. Those that don't will watch the projects go to neighboring counties.

Massillon's willingness to engage legal expertise suggests awareness that this is a multi-layered problem. The zoning piece is the most visible, but the interconnection and clean energy regulatory threads are arguably more complex — and more consequential for whether the project delivers on its economic promise.

What Comes Next

For Massillon, the immediate path forward is clear enough: get the legal framework right, structure the incentives with appropriate safeguards, and create a zoning classification that can accommodate data centers as a recognized use type rather than treating each project as a novel puzzle.

For other communities watching this play out, the Massillon data center situation is worth studying closely. The Republic Steel site is a microcosm of a national inventory problem — millions of acres of former industrial land that could host the infrastructure the digital economy needs if the regulatory architecture can be updated fast enough to meet the moment.

The deeper takeaway for infrastructure investors and developers: cities that have done the legal and regulatory groundwork are increasingly worth paying a premium to enter. The cost of a zoning fight — in time, legal fees, and relationship capital — routinely exceeds the cost of a more expensive but legally buttoned-up site. Massillon's move to get ahead of that curve rather than stumble into it is exactly the kind of governance signal that serious developers notice.

The steel is long gone. What gets built on that ground now depends on whether the city can write rules fast enough to meet the investors already circling.
