What Standards Should Govern Data Centers Today?

The Governor must establish clear standards for data centers. That sentence — sparse as it is — contains a policy challenge that the entire industry is watching play out in real time. Right now, the rules governing how data centers are built, who pays for the infrastructure they demand, and what environmental commitments they must honor are inconsistent at best and nonexistent at worst.
That's a serious problem. Data centers now underpin everything from hospital records to financial transactions to the AI models reshaping entire industries. When the infrastructure holding all of that together operates without coherent standards, the costs don't disappear — they just get shifted. Onto ratepayers. Onto communities. Onto grid operators who didn't see the demand surge coming.
The framework being called for isn't bureaucratic overreach. It's the minimum viable structure for an industry that has outgrown the regulatory environment it was born into.
The Four Things a Real Standard Must Address
When policymakers talk about data center standards, they often drift toward vague commitments — sustainability goals, community engagement, responsible development. That language sounds good in a press release but means almost nothing in practice.
Effective standards must be specific enough to be enforceable, or they're just suggestions with better branding.
The clearest starting point is cost responsibility. The developer pays full freight. That principle sounds obvious, but it runs directly against how data center development has worked in many markets, where developers negotiate infrastructure cost-sharing arrangements that effectively transfer grid upgrade costs to existing ratepayers. A data center drawing 500 MW from a regional grid — and hyperscale facilities are regularly hitting those numbers now — requires transmission upgrades, substation capacity, and potentially new generation. None of that should land on the residential customer who had no say in the project.
Beyond cost, effective standards need to address:
Environmental impact with teeth. Not a pledge to achieve carbon neutrality by some future decade, but measurable, time-bound commitments to water usage effectiveness (WUE), power usage effectiveness (PUE), and renewable energy sourcing — with reporting requirements that are actually audited.
Security protocols tied to physical and cyber infrastructure. Data centers are critical infrastructure. They need to be treated that way, with hardening requirements, redundancy standards, and incident reporting obligations that match their role in the broader digital economy.
Compliance mechanisms that don't expire at the ribbon cutting. Too many development agreements front-load the commitments and back-load the accountability gaps. Operating standards need to persist and evolve as the facility scales.
Who Pays When There Are No Rules
The consequences of regulatory ambiguity aren't theoretical. They're showing up on utility balance sheets and in grid operator interconnection queues right now.
PJM Interconnection, which manages the grid across 13 states and the District of Columbia — including some of the densest data center markets in the country — reported a backlog of over 2,500 projects seeking grid connection in recent years, with data centers representing a growing share of that demand. When standards don't exist to govern how that demand gets queued, priced, and managed, the result is gridlock. Projects that should move fast don't. Projects that shouldn't move at all sometimes do.
The absence of a clear standard doesn't create a free market — it creates an advantage for whoever has the best lawyers.
Smaller developers and municipalities negotiating with hyperscale operators are structurally outmatched without a regulatory floor to stand on. A well-resourced developer can spend years litigating infrastructure cost allocations that a clear standard would resolve in weeks. Meanwhile, the grid waits, the demand grows, and the costs accumulate.
Operational inefficiencies compound the problem. Data centers operating without standardized efficiency benchmarks have little external pressure to optimize. The average PUE for U.S. data centers has improved significantly over the past decade — Google's fleet operates below 1.1, compared to an industry average closer to 1.5 — but that gap exists largely because leading operators made internal efficiency a competitive priority, not because standards required it. In markets where standards are absent, laggards face no meaningful pressure to close that gap.
What Good Regulation Actually Looks Like
Virginia offers the most instructive case study, for better and worse. Northern Virginia hosts the largest concentration of data center capacity on the planet — estimates put it north of 30% of global data center capacity within a roughly 35-mile radius. The scale is staggering.
The regulatory framework that grew around it has been uneven. Virginia enacted data center tax incentive programs that drove explosive growth, but the grid infrastructure required to support that growth strained Dominion Energy's planning assumptions significantly. The state has since moved to require more rigorous impact assessments and cost-allocation frameworks — but largely in response to problems that better upfront standards might have avoided.
The lesson isn't that Virginia got it wrong. It's that Virginia got it in the wrong order. Incentives came before standards. Growth came before infrastructure accountability. Building the rules after the industry arrives is always harder than building them before.
On the other side of the ledger, jurisdictions that have implemented clear interconnection cost responsibility rules — where the developer bears the cost of network upgrades triggered by their project — have seen more disciplined development patterns. Projects get sited where the grid can actually support them, rather than where land is cheapest and interconnection costs can be externalized.
Where the Regulatory Frontier Is Moving
Three forces are reshaping what data center standards need to cover going forward.
AI workloads are changing the load profile. Traditional data centers had relatively predictable, consistent power draws. AI training clusters are different — they run at high utilization for sustained periods, with power demands that can spike sharply and stress grid stability in ways conventional data center standards weren't designed to address. Standards written for the 2010s data center are already partially obsolete for the 2020s AI infrastructure buildout.
Water is becoming the next flashpoint. Power usage effectiveness gets most of the attention, but water usage effectiveness is an equally serious issue in water-stressed regions. A large hyperscale facility can consume millions of gallons of water annually for cooling. In regions already managing drought risk, that's not a secondary concern — it's a site selection and permitting issue that standards need to address directly.
The energy efficiency imperative is converging with grid policy. Federal clean energy goals, state renewable portfolio standards, and corporate net-zero commitments are all pointing in the same direction: data centers need to source clean power, and that sourcing needs to be real — matched on an hourly basis, not just annually on paper. The difference matters enormously. Annual matching allows a facility to claim clean energy credentials while drawing coal power at peak hours and retiring renewable energy certificates from off-peak generation elsewhere. Hourly matching eliminates that arbitrage.
The standard that matters isn't the one that looks good in a press release — it's the one that holds up at 2 a.m. when the grid is stressed and the facility is running at full load.
The Practical Takeaway for Developers
If you're developing data center infrastructure — or advising on it — the window for operating in regulatory gray zones is closing. The direction of travel is clear: more cost responsibility, more environmental accountability, more rigorous security and compliance requirements.
That's not necessarily bad news for well-prepared developers. Clear standards reduce uncertainty. They level the competitive playing field against operators who have historically gamed ambiguous rules. They make financing easier, because lenders can underwrite to a known regulatory environment rather than speculating on future policy risk.
The Governor setting a clear standard isn't an obstacle to data center development. Done right, it's the foundation that makes serious, long-term data center development possible. The developers who understand that distinction will be better positioned for what comes next than the ones still lobbying against accountability frameworks they're eventually going to live under anyway.
