A moratorium, in the end, isn't necessarily a "no." It's often a "not yet, and not like this." Developers who understand that distinction will be better positioned than those who treat every regulatory pause as a political problem to overcome.

The states implementing the most thoughtful frameworks for AI infrastructure review today are likely to become the preferred destinations for long-term data center investment. That's the counterintuitive bet worth making β€” that getting the rules right now is more valuable than moving fast and generating the kind of backlash that produces actual prohibition.

Artificial intelligence infrastructure is going to be built. The question is whether the industry helps design the guardrails or waits until legislators do it for them.
