That tension — between a sector that moves at the speed of capital and local governments that move at the speed of public comment periods — is defining where the next wave of infrastructure development can and cannot happen.

What a Moratorium Actually Does (and Doesn't Do)

Markets with pre-cleared, data-center-ready zoning — jurisdictions that have done the planning work and explicitly welcome the sector — command premium prices for land precisely because they eliminate regulatory risk. Developers paying that premium are often making a rational calculation: certainty is worth more than a cheaper site that might be frozen for 18 months.

Some operators are also exploring hybrid development models that address the community concerns underlying most moratoriums. Co-locating with industrial parks, committing to local apprenticeship programs for construction trades, and structuring power purchase agreements that benefit local ratepayers rather than bypassing them entirely — these aren't just PR moves. They're responses to the specific objections that tend to generate moratorium pressure in the first place.

Where This Is Headed

Moratoriums are a lagging indicator. They appear after development pressure has already arrived, which means the pattern will continue to spread as data center demand keeps growing. Artificial intelligence infrastructure buildout is accelerating electricity demand projections that would have seemed implausible three years ago — some estimates put hyperscale power demand growing at 20 to 25 percent annually through the end of the decade. That demand has to land somewhere physically, and it will keep finding its way into communities that weren't necessarily planning for it.

The regulatory response will mature, but unevenly. States like Virginia, which hosts the densest concentration of data center infrastructure on the planet, have developed relatively sophisticated frameworks for managing the sector. Ohio, Texas, and other states seeing accelerating interest are earlier in that process. The Sunburys and Mount Orabs of those states are effectively drafting the playbook in real time.

For infrastructure investors and developers, the strategic implication is clear: jurisdictions that do the planning work now — that write thoughtful, specific zoning frameworks rather than blanket moratoriums — will attract the next wave of development on better terms for everyone involved. The communities that wait for development pressure to force their hand will keep reaching for the pause button.

The moratorium isn't the end of the story. It's the part where the municipality decides whether it wants to be a passive recipient of whatever the market brings or an active participant shaping what gets built, where, and under what conditions. That distinction will matter enormously as the infrastructure buildout of the next decade unfolds.
