A specialized water attorney in the relevant jurisdiction can identify in days what would take a generalist weeks β whether rights are available, what class of rights exists, who the senior holders are, and whether existing uses are legally defensible. That intelligence should shape site selection, not just confirm it.
Water rights specialists β separate from legal counsel β can conduct technical assessments of aquifer yield, surface flow availability, and historical use patterns. In competitive acquisition environments, having this analysis in hand at LOI gives developers a real advantage.

In the Colorado River Basin, where the system is already overallocated and new appropriations are essentially unavailable, this isn't just a strategy β it's the only viable path.

The cautionary tale pattern is consistent. A developer identifies an attractive site for a large-scale solar or data center project in a western state, completes environmental and land-use due diligence, closes on acquisition β and then discovers during detailed engineering that the water supply assumptions embedded in the project pro forma have no legal basis. The wells that served the prior agricultural use were tied to water rights that didn't transfer with the land, or transferred encumbered, or were junior rights that get cut off in dry years.
Projects that have navigated this successfully share a few common traits. They engaged water counsel in the feasibility phase, not the permitting phase. They built water rights contingencies into their purchase agreements β similar to how environmental contingencies are structured. And they treated water as a cost center worth investing in, budgeting for rights acquisition or legal proceedings rather than assuming the problem would resolve itself.
