Can Local Governments Control Data Center Development?

When Wise County Commissioners asked state lawmakers to either rein in data center development or hand counties the power to do it themselves, they weren't making a parochial complaint. They were articulating something that dozens of rural and suburban communities across the country are quietly wrestling with: who actually controls what gets built, where, and at what cost to the people who live there?

That question is now urgent — and the answer is messier than most people realize.

The Data Center Gold Rush Nobody Voted For

Data centers are the physical backbone of the digital economy. Every cloud storage file, every streamed video, every AI query resolves somewhere into a building full of servers drawing enormous amounts of power and water. Global demand for that infrastructure has exploded, and the buildout is accelerating faster than most regulatory frameworks were designed to handle.

The facilities going up today aren't the modest server rooms of 15 years ago — hyperscale campuses can consume 100–500 megawatts of power, rivaling the electricity draw of small cities.

For developers, the economics are compelling enough to move fast and deal with complications later. For the communities hosting these facilities, the timeline feels inverted: consequences arrive before the conversation.

Wise County's commissioners aren't opposed to economic development. What they're pushing back against is the lack of meaningful local authority over where these projects land, how large they grow, and what obligations — environmental, infrastructural, financial — come with them. Their appeal to state lawmakers reflects a structural gap: zoning and land-use authority in many states gives counties limited tools to govern industrial-scale technology infrastructure in ways that actually match the scale of the impact.

The Local vs. State Control Fault Line

The tension here isn't new, but data centers sharpen it considerably.

Most states give counties authority over zoning, setbacks, and basic land use. What they don't always provide is clear statutory power to impose sector-specific requirements — things like grid impact assessments, water use disclosures, or minimum tax-contribution thresholds — on technology infrastructure that often gets classified alongside light industrial or commercial uses. A data center drawing 200 MW from a regional grid is not a light industrial use. But without explicit state-level guidance, counties often lack the legal footing to treat it as anything different.

That's the core of what Wise County is asking for. Either the state sets consistent rules that apply to data center development — something resembling the energy facility siting processes that govern power plants — or it gives county governments clear authority to set those rules locally.

Both paths have tradeoffs. State-level frameworks provide consistency and prevent a race to the bottom on standards, but they can also strip communities of context-specific control. Full local authority risks a patchwork of regulatory environments that slows legitimate investment.

What's notable about Wise County's position is the implicit acknowledgment that the status quo — where neither level of government has clearly defined authority — serves nobody well. Developers operate in a gray zone, communities feel powerless, and long-term planning becomes nearly impossible.

The Economic Math Doesn't Always Add Up Locally

Proponents of aggressive data center development often lead with job creation and tax base arguments. Both are real — to a point.

Data centers do generate significant property tax revenue in jurisdictions without abatement agreements, and construction phases create genuine local employment. But the operational footprint is often surprisingly thin. A hyperscale facility might employ 30–50 full-time workers while drawing infrastructure resources — power grid capacity, road access, emergency services — that strain local systems serving tens of thousands of residents.

Worse, many states and localities have offered data center tax exemptions to attract investment, particularly on equipment purchases. Virginia, which hosts the highest concentration of data center capacity in the world in Loudoun County's "Data Center Alley," has had ongoing policy debates about whether these exemptions — which cost the state hundreds of millions in foregone sales tax revenue annually — actually pencil out for residents once infrastructure costs are factored in.

The risk of unregulated growth isn't just theoretical. Communities that approved large-scale facilities without negotiating adequate community benefit agreements, grid impact mitigation, or long-term maintenance commitments have found themselves holding costs the developers never shared. When infrastructure serves private industrial demand but is funded through public utility rates or county budgets, that's a transfer of value that rarely shows up in the press release announcing the project.

Wise County's concern about state control over data center development is, at its core, a question about who absorbs risk and who captures reward — and whether the current framework is honest about that division.

Energy, Land, and the Infrastructure Strain Nobody Talks About

The energy dimension of data center expansion deserves direct treatment because it's where the rubber meets the road for grid operators, utilities, and ratepayers.

A single large data center campus can require the equivalent of a new substation and potentially new transmission infrastructure to serve it. In regions already managing constrained grid capacity or pursuing decarbonization goals, adding hundreds of megawatts of 24/7 baseload demand isn't neutral. It shapes what generation resources get built, what gets retired, and ultimately what everyone else pays for power.

Water consumption adds another layer. Many data centers use evaporative cooling systems that consume millions of gallons of water annually — a real concern in drought-prone or water-stressed regions where local governments have little ability to require disclosure, let alone mitigation.

Land use is subtler but equally consequential. Data centers require large, flat parcels with strong grid interconnection — the same characteristics that make land attractive for solar development, warehousing, or agricultural use. Locking up those parcels for data center use without a transparent process forecloses optionality that communities may not realize they're surrendering until years later.

From an insider perspective: utility and grid planners are already flagging data center load growth as one of the most significant near-term planning variables they face. PJM Interconnection, which manages the grid across 13 states including Virginia, has cited data center demand as a primary driver behind its growing interconnection queue backlog. That's not an abstract infrastructure statistic — it has direct implications for reliability, cost, and the pace of renewable integration for everyone in those service territories.

What a Better Framework Actually Looks Like

Several jurisdictions have begun building more sophisticated regulatory approaches worth watching.

Loudoun County, ironically, provides both a cautionary tale and a model. After years of largely permissive development, the county implemented overlay district requirements, visibility standards, and began requiring more substantive infrastructure contribution agreements from developers. The lesson: it's significantly easier to establish standards before a buildout pattern is established than to retrofit them once the industry has shaped local expectations.

Prince William County in Virginia took a more deliberate approach with its Digital Gateway district, limiting data center development to designated zones while preserving agricultural and rural land elsewhere. Whether that model is replicable depends heavily on local geography and politics, but the underlying logic — define where this development is appropriate before it defines itself — is sound.

At the state level, a handful of legislatures have started exploring data center siting frameworks analogous to those governing power plants or large industrial facilities. These typically involve environmental impact assessments, grid capacity studies, and mandatory public comment periods. They slow individual projects but create a more durable and defensible approval process.

The goal isn't to stop data center development — it's to ensure the approval process is honest about costs, generates fair community contributions, and preserves meaningful local input.

For Wise County and communities in similar positions, the immediate ask is reasonable: either establish clear state standards that account for data center scale and impact, or explicitly grant counties the regulatory tools to do it themselves. The current arrangement — where neither happens — isn't neutrality. It's a structural advantage for whoever moves fastest.

Data centers will continue to be built. The demand driving them — AI infrastructure, cloud computing, enterprise IT — isn't going away, and the buildout timeline is measured in years, not decades. The jurisdictions that establish clear, fair, workable regulatory frameworks now will be in a fundamentally stronger position than those still arguing about authority when the next 500-MW campus application lands on their desk.

Wise County is having that argument at the right time. The question is whether state lawmakers are listening before it becomes irrelevant.
