What they're pushing back against is the lack of meaningful local authority over where these projects land, how large they grow, and what obligations — environmental, infrastructural, financial — come with them. That's not an abstract infrastructure statistic — it has direct implications for reliability, cost, and the pace of renewable integration for everyone in those service territories.
What a Better Framework Actually Looks Like
Several jurisdictions have begun building more sophisticated regulatory approaches worth watching.
Loudoun County, ironically, provides both a cautionary tale and a model. After years of largely permissive development, the county implemented overlay district requirements, visibility standards, and began requiring more substantive infrastructure contribution agreements from developers. The lesson: it's significantly easier to establish standards before a buildout pattern is established than to retrofit them once the industry has shaped local expectations.
Prince William County in Virginia took a more deliberate approach with its Digital Gateway district, limiting data center development to designated zones while preserving agricultural and rural land elsewhere. Whether that model is replicable depends heavily on local geography and politics, but the underlying logic — define where this development is appropriate before it defines itself — is sound.
At the state level, a handful of legislatures have started exploring data center siting frameworks analogous to those governing power plants or large industrial facilities. These typically involve environmental impact assessments, grid capacity studies, and mandatory public comment periods. They slow individual projects but create a more durable and defensible approval process.
The goal isn't to stop data center development — it's to ensure the approval process is honest about costs, generates fair community contributions, and preserves meaningful local input.
For Wise County and communities in similar positions, the immediate ask is reasonable: either establish clear state standards that account for data center scale and impact, or explicitly grant counties the regulatory tools to do it themselves. The current arrangement — where neither happens — isn't neutrality. It's a structural advantage for whoever moves fastest.
Data centers will continue to be built. The demand driving them — AI infrastructure, cloud computing, enterprise IT — isn't going away, and the buildout timeline is measured in years, not decades. The jurisdictions that establish clear, fair, workable regulatory frameworks now will be in a fundamentally stronger position than those still arguing about authority when the next 500-MW campus application lands on their desk.
Wise County is having that argument at the right time. The question is whether state lawmakers are listening before it becomes irrelevant.
